ARMENIAN CEC CHAIRMAN STATED THAT THE RESULTS OF ELECTIONS FULLY CORRESPOND TO THE REALITY

Yerevan /Mediamax/. Constitutional Court (CC) of Armenia continued
today the consideration of the application of presidential candidates
Tigran Karapetian and Levon Ter-Petrosian on nullifying the results
of presidential elections of February 19.

Mediamax reports that the Chairman of the Central Electoral Commission
(CEC) of Armenia Garegin Azarian, who was defendant in CC, stated
that accusations on violation of the basic principles of electoral
law, established in the Constitutional and the Electoral Code, are
of subjective nature, are based on peculiar commentary of laws and
are not backed by corresponding materials.

Garegin Azarian informed the Court that CEC carried out the whole work
on organization of the presidential elections in accordance with the
schedule, established on November 7 of 2007, and the Commission has
not received any complaints concerning that.

The defendant’s part agreed to the claim that the state bodies do not
have the right to realize agitation, however, Garegin Azarian stated,
the circle of authority of a state figure in the electoral period is
comprehensively presented in the Constitution.

At the same time, the CEC Chairman stated that the commission does not
reject the presence of certain violations of the electoral legislation;
however, it cannot agree to the statement that those violations were of
"organized or systematized nature".

Garegin Azarian described as correct the decision of CEC to carry
out investigation of facts of violation together with the General
Prosecutor’s Office of Armenia, since some of them had the nature of
criminal offence.

CEC Chairman stated that, despite the minor shortcomings, the results
of presidential elections completely correspond to the reality, and the
elections proceeded in accordance with the Electoral Code of Armenia.

CC will hear the second part of the defendant’s speech tomorrow.
