Decision of Appeal Court on Gala Case To Be Made Public on April 14

DECISION OF APPEAL COURT ON GALA’S CASE TO BE MADE PUBLIC ON APRIL 14

YEREVAN, APRIL 12, NOYAN TAPAN. The RA Civil Appeal Court (chairman –
Judge Tigran Sahakian) on April 14 will make public the decision on the
case "Gyumri mayor’s office versus Chap LLC – owner of Gala television
company". The court started examining the case on April 11. Chap LLC’s
representative Karen Tumanian filed an appeal petitioning to overturn
the February 29 decision of the Shirak regional court and to send the
case to the same court for new examination. The mayor’s office has not
responded in any way to the appeal.

In the words of Chap LLC’s representative, in passing the sentence, the
court made violations of Procedural Law and Substantive Law. A number
of articles of the RA Constitution, the European Convention on Human
Rights, the Civil Procedure Code were violated as well.

To recap, the Shirak regional court (chairman – Judge A. Khachatrian)
sustained the claim of the mayor’s office requesting "to eliminate
violations of the ownership rights" and ruled to oblige Chap LLC to
dismantle its broadcasting antenna from the television tower
representing the property of the mayor’s office. By the same decision,
the court rejected the claim filed by Chap LLC with the request "to
establish a compulsory servitude" against the mayor’s office.
