RIGHTS OF 1514 CITIZENS ARE RESTORED

In October 2007 Armenia’s human rights defender applied to the
RoA Constitution Court to repeal Article 73.2 since it contradicts
to Article 42.3 of the RoA Constitution. On January 15, 2008 the
CC decided that before the enactment of the law on pensions many
people who had worked in difficult conditions and were entitled to
a pension expected a privilege in the order of calculating the size
of their pension.
The human rights defender also disputed the compliance of Article
47.3 and Article 47.4 of the law on pensions to Article 18 of the
Constitution. According to the above-mentioned provision, in case of
25 years of insurance service the service cannot be affirmed through
the court. The court affirms only the missing part of the required
service but not more than ten years of service.
In January 2008 the CC met both applications of the human rights
defender. After the CC decisions on the applications of the ombudsman
the State Social Insurance Service and the government took joint
action to restore the rights of citizens.
During the telephone talk between Human Rights Defender Armen
Harutiunian and the head of the State Social Insurance Service of the
Ministry of Social Affairs Vazgen Khachikian the latter informed that
after repealing several provisions of the law on pensions recalculation
was administered, and the rights of 1514 citizens were restored,
the department of information and pubic relations of the human rights
defender’s office reports.
