CONSTITUTIONAL COURT OF ARMENIA: RELATIONS BETWEEN ARMENIA AND TURKEY CONCERN ONLY THESE TWO COUNTIES AND NO THIRD PARTY

ArmInfo. The provisions fixed in Armenian-Turkish Protocols "On
establishment of diplomatic relations" and "On development of bilateral
relations" comply with the Constitution (CC) of Armenia.

According to Clause 102 of the Constitution, this resolution is final
and can’t be revised, it comes into force since the moment of its
publication, said CC Chairman Gagik Haroutyunyan on Tuesday.

The CC resolution read out by Gagik Haroutyunyan, reported that
having considered Armenian President Serzh Sargsyan’s statement,
as well as the written statement of the acting rapporteur, written
explanation of the president’s official representative – Armenian
Foreign Minister Edward Nalbandian, as well as the Protocols and other
documents, the Court has ruled that the mutual commitments assumed by
the two countries in compliance with international law when signing
the bilateral Protocols have only a bilateral interstate essence and
can’t concern any third party.

It was also pointed out that the Protocols are to come into force on
the first day of the first month after the two parties exchange the
ratified documents, and either of the Protocols has no legal force
and can’t come into force without the other Protocol.

Thus, the Constitutional Court of Armenia delivered a judgement on the
basis of the results of 5-hour sitting. At that time ARF Dashnaktsutiun
was still picketing the building of the court, during the picket the
opponents of the protocols carried out a symbolic "burning" of these
documents. Now the National Assembly of Armenia is to make the final
decision: either ratifying the Protocols or rejecting them.

To recall, the bilateral Protocols were signed in Zurich by Armenian
and Turkish Foreign Ministers Edward Nalbandian and Ahmet Davutoglu on
10 Oct 2009. US Secretary of State Hillary Clinton, Foreign Minister
of France and Russia Bernard Kouchner and Sergey Lavrov, and EU High
Representative for the Common Foreign and Security Policy, Javier
Solana, were present at the ceremony of signing of the documents.
