INVESTIGATOR USED VIOLENCE AGAINST INMATE TO GET TESTIMONY

A criminal case has been launched in the Special Investigation Service
of the Republic of Armenia based on the report of Bavakan Kh., a
prisoner of “Abovyan” Criminal-Executive Institution of the Republic
of Armenia, in accordance with Part 2 of Article 309 of the country’s
Criminal Code.

Bavakan Kh. reported that in the night between April 5 and 6, 2013
the police employees of the Republic of Armenia and the Investigator
of the Principal Investigation Department of the Armenian Police who
was in charge of conducting the preliminary investigation, committed
violence against him both in the police building and the principal
investigation department for the purpose of getting testimonies from
him. They struck different parts of his body with legs and hands,
as result of which he was forced to give confessionary testimonies
inconsistent with the reality.

A preliminary investigation is underway.

The suspect or the accused of the alleged offence is deemed innocent
unless his or her innocence is proved by virtue of the effective court
verdict in the manner prescribed by the Criminal Procedure Code of
the Republic of Armenia.
