An Azerbaijani judge, one of the judges of the European Court of Human Rights, Latif Huseynov, has a 'dissenting opinion' on the ECHR ruling over the death of Armenian shepherd Manvel Saribekyan.
The ECHR ruled that Azerbaijan violated two articles of the Convention on Human Rights and should pay over EUR 60 thousand as moral damage and legal costs.
The decision of the court also includes the judges making the decisions. One of them was Latif Huseynov. Huseynov’s 'dissenting opinion' is attached to the decision, who has no choice but to explain that he disagrees with the majority’s opinion. According to him, the present complaint should have been declared inadmissible since it was filed after a six-month period. Further, he elaborated 'very important' legal subtleties when a lawsuit should be filed.
Each court ruling is posted with the votes for it. So, one can easily trace the trend: one of the judges voted against in all respects and it is not difficult to guess who exactly.
Manvel Saribekyan, resident of Ttu Jur village of Armenia, was taken into Azerbaijan’s captivity in September 2010. Saribekyan was a civilian, a shepherd, while Azerbaijan persistently called him an Armenian “saboteur”. Later it was reported he allegedly hang himself on October 5.
The Armenian side claimed he was either killed or forced to commit a suicide. It was proved by the fact that the Azerbaijani side refused to return his body for a month. On November 4, Azerbaijan handed his body to the Armenian side under agreement reached by Armenian, Azerbaijani and Russian leaders during their meeting in Astrakhan last October.
