Candidate for judge of the Constitutional Court of Armenia Artur Vagharshyan today declared that the idea of establishing a Supreme Court can be considered, adding that there are two supreme court instances in Armenia, including the Court of Cassation and the Constitutional Court.
“The Court of Cassation accepts cases from the Court of Appeal when there is an issue of application and interpretation of legal acts. The Constitutional Court accepts cases when there is an issue on compatibility of a legal act with the Constitution. I’m not against the idea of establishing a Supreme Court, but the system of the current two Courts is based on German legislation, and the system of the Supreme Court is based on US legislation,” he said.
He stated that the tertiary system of the court of general jurisdiction, the Court of Cassation and the Court of Appeal may be turned into a two-level system, and the Supreme Court may adopt acts only when there is an issue related to the validity of constitutional laws.
