DECISION ON JHANGIRIAN’S CLAIM TO BE ANNOUNCED TOMORROW

Today the RA Administrative Court continued the investigation of RA
Deputy Attorney General Gagik Jhangirian’s claim, which challenges
the legitimacy of Robert Kocharian’s decrees. Judge Artsrun Mirzoyan
had to ask photojournalist Gagik Shamshian and journalist Gayane
Arustamian to leave the court-room, as they were trying to defend
their right of photographing, which according to the Judge, would
hinder the trial process.
For about 40 minutes Lawyer Lusine Sahakian was delivering her speech,
which tried to justify that Robert Kocharian’s decision to relieve
Jhangirian of his post and deprive him of his class degree were
illegal and contradicted the Constitution. She introduced all the
grounds for the decree to be recognized unlawful.
"The decree limits Jhangirian’s freedom of expression and his right
for rallies. He has been given discriminative treatment. Many officials
participated in the opposition rally and they all used their freedom of
expression and right for rallies. It is unfair," declared the lawyer.
By the way the decree has not been recognized valid yet, as the
Constitution states that decrees are considered valid from the moment
they are presented to the person they concern, after which he signs
it, whereas Jhangirian has not been given any decree. "Quite possibly
they did not know where I was," commented Jhangirian.
The decision of the court will be announced tomorrow at 9:30 a.m.
