Vardan Jhangiryan-brother of former RA Deputy Prosecutor General
Gagik Jhangiryan-was acknowledged as guilty based on the 1st part
of Article 316 of the RA Criminal Code and was sentenced to prison
for three years. Thus, he was sentenced for a non-dangerous assault
against a state official, although he was charged for a dangerous
assault based on the 2nd part of Article 316 of the RA Criminal Code.
Since Vardan Jhangiryan had been in jail for 3 months and 23 days, the
Kentron-Nork Marash first instance court judge Mnatsakan Martirosyan
sentenced him to 2 years 8 months and 7 days. The penalty will not
be conditional and there will be three years of Jhangiryan will
be supervised by the department of alternative penalties of the
penitentiary of the Justice Ministry.
As a precautionary measure, Judge Mnatsakanyan left the signature
for leaving the country unchanged until the verdict is in effect. In
addition, the assets of Jhangiryan under arrest is eliminated. The
verdict may be appealed within a month at the Appeals Court.
"I thought that the precautionary measure would be validated and Vardan
Jhangiryan would be able to leave for abroad for treatment. This is
an abuse if we take into consideration the precedents of the European
Court," said Vardan Jhangiryan’s advocate Lusine Sahakyan.
That is why when they appealed to the European Court they had declared
that by abusing Vardan Jhangiryan the court is actually abusing Gagik
Jhangiryan. Vardan Jhangiryan has been receiving treatment for the
past year, yet there are no results. That is why he has to leave for
Germany for treatment.
Jhangiryan’s advocates are planning to appeal the verdict without any
hope. Since they have already appealed to the European Court, they
are going to ask for a rapid examination due to Vardan Jhangiryan’s
critical health condition.
