Mass communication students from 174 universities to participate in 2nd GMC workshops

ABU DHABI, 24th August, 2023 (WAM) — The second edition of the Global Media Congress (GMC) will welcome mass communication students from 174 universities around the world.

Comprising a conference and an exhibition, the GMC will take place from 14th to 16th November, 2023, at the Abu Dhabi National Exhibition Centre (ADNEC), under the patronage of His Highness Sheikh Mansour bin Zayed Al Nahyan, Vice President, Deputy Prime Minister and Minister of the Presidential Court.

The event is organised by the ADNEC Group, in partnership with the Emirates News Agency (WAM), and the participation of global industry leaders, specialists and influencers, as well as academics and youth.

The workshops held on the sidelines of the GMC will welcome students from 24 local universities, 19 GCC, 47 Arab and 84 foreign.

The students' participation comes at the invitation of GMC, which aims to develop expertise and expose students to the media industry, the various functions of media outlets, and their role in developing communities by tackling a variety of challenges.

These challenges include climate change and promoting tolerance, coexistence and acceptance of others to achieve world peace.

Additionally, the GMC workshops are designed to acquaint students with media technologies and tools, guiding them to become successful media professionals capable of pushing forward progress and prosperity in their countries.

The GMC will cover key topics over the span of three days, such as media education, environmental and sustainability-related media, sports media, as well as media education, and relevant challenges, opportunities and the utilisation of innovation and new tech solutions.

The 2023 Global Media Congress is a major international event that brings together media institutions from different parts of the world to explore the future of the global media industry and its vital role in advancing sustainable development across the world.

It will also create opportunities to promote collaborations and build media partnerships that can drive the media industry’s transformation, ensure its sustainability, and enable it to produce reliable, diverse and innovative content that keeps pace with the fast-paced technological advances happening in the world.

Outgoing EU Ambassador awarded Medal of Honor by Speaker of Parliament

YEREVAN, AUGUST 15, ARMENPRESS. Speaker of Parliament Alen Simonyan awarded outgoing EU Ambassador Andrea Wiktorin with the Medal of Honor of the National Assembly during a farewell meeting on August 15.

Simonyan thanked the Head of the Delegation of the European Union for her great contribution to the strengthening and deepening of relations between Armenia and the EU and Armenia’s sustainable development.

“Knowing you and seeing your caring work for the development of democratic institutions, I reiterate our commitment to democratic values and readiness to not spare any effort,” Simonyan said during the meeting.

He highlighted the ambassador’s direct participation in the projects that are aimed at supporting the development and strengthening of resilience of Armenia’s southern regions. 

Wiktorin said that the EU continues to be the primary partner supporting the Armenian government’s reforms agenda.

During the meeting the parties also discussed the deployment of the EU monitoring mission in Armenia and the upcoming UN Security Council meeting on the humanitarian situation in Nagorno-Karabakh.

Simonyan presented the Medal of Honor of the National Assembly to Wiktorin for “significant contribution in strengthening the interparliamentary friendly ties and development of democracy’, the parliament’s press service said.

Azerbaijani Defense Ministry releases more disinformation

YEREVAN, AUGUST 15, ARMENPRESS. The Azerbaijani Defense Ministry has released more disinformation, the Armenian Defense Ministry warned Tuesday evening.

The Armenian Defense Ministry said that Azerbaijan has again falsely accused Armenia of opening fire. 

“The statement issued by the MoD of Azerbaijan as if the units of the Armed Forces of Armenia fired against the Azerbaijani combat outposts located in the eastern part of the border on August 15, at around 6:05 p.m., is another disinformation,” reads the statement issued by the Armenian Defense Ministry.

Iran extends gas-for-electricity swap deal with Armenia

TEHRAN – The National Iranian Gas Company (NIGC) has renewed and revised a contract with Armenia to increase the volume of natural gas exports to the landlocked neighboring country until 2030, Shana reported.

The terms of the contract, under which Iran exports natural gas to Armenia in exchange for electricity, have been revised so that the energy exchange ratio is significantly improved in favor of the NIGC.

The contract was finalized this week during a ceremony in Yerevan attended by senior officials from both countries, including NIGC Head Majid Chegeni, Iran’s ambassador to Armenia Mehdi Sobhani, and Aram Ghazaryan, the CEO of the Yerevan Thermal Power Plant.

The preliminary agreement to extend the gas-for-electricity swap deal was worked out during Armenian Prime Minister Nikol Pashinyan’s visit to Tehran in November last year.

Officials say the Iran-Armenia gas pipeline has the capacity to transfer over one billion cubic meters of natural gas to Armenia every year.

UNSC meeting: Japan calls for unimpeded humanitarian access,Brazil calls for urgent solution to existing situation in NK

YEREVAN, AUGUST 16, ARMENPRESS. Humanitarian access must be unimpeded for international organizations, Japan said at the UN Security Council emergency meeting on the humanitarian crisis in Nagorno-Karabakh.

“We took note of the letters by Armenia and Azerbaijan distributed to the Security Council. The arguments of both sides offer different explanations,” Kimihiro Ishikane, Permanent Representative of Japan to the UN said in his statement. “However, safeguarding local livelihoods must be the utmost priority. The lives of the most vulnerable, including the sick and chronically ill, elderly, women, infirm and children, must not be threatened. We recall the Secretary-General’s concern over reports of continued challenges to the freedom of movement along the Lachin Corridor and the deteriorating humanitarian situation on the ground. The ICRC is currently facing difficulties to bring humanitarian assistance to the civilian population through the Lachin Corridor or any other routes. It is calling on the relevant decision makers to let it resume its essential humanitarian operations in the area. Humanitarian access by international organizations must be unimpeded. We urge all parties to grant access as soon as possible.
 In addition, the ICJ indicated provisional measures on 22 February 2023 related to ensuring unimpeded movement of persons, vehicles and cargo along the Lachin Corridor in both directions. We reiterate our consistent position that the rule of law must be upheld and that any nation must abide by international law, including the UN Charter and international humanitarian law. The final settlement of the conflict between Azerbaijan and Armenia is crucial for peace and stability in the Caucasus region. The Security Council, which is tasked with maintaining international peace and security, should be committed to this issue. Dialogue between Armenia and Azerbaijan is important. We hope that it will allow issues related to their dispute to be resolved peacefully in accordance with international law,” he added.

Brazil also called for dialogue.

The Brazilian envoy to the UN said in his speech that an urgent solution must be found to the current situation because it could further deteriorate in the next months.

Brazil is concerned with reports on deteriorating humanitarian situation in Nagorno-Karabakh, the Brazilian envoy said.

“Brazil reiterates its commitment to respect the sovereignty and territorial integrity of Armenia and Azerbaijan as part of their internationally recognized borders, but fundamental principles of human rights must be taken into account during tightening of border control, in order to prevent the suffering of innocent civilians,” he said.

Brazil also called for maintaining channels of dialogue between the parties, as well as adhering to the terms of the ceasefire agreement. He said that the UNSC must closely follow the developments in Nagorno-Karabakh and express maximal support.

“I urge Baku to refrain from steps that nullify the historical possibility of establishing peace”, the Prime Minister of Armenia said on the blockade of the Lachin corridor in his latest statement. Calls to open the road are heard not only from Armenia, but also from international structures, in particular the UN.

European Union announced that they “took note of the readiness of the authorities of Azerbaijan to deliver goods through the city of Agdam. This should not be considered as an alternative to the opening of the Lachine Corridor.” But Aliyev’s position has not changed, and he urges Armenians to either accept Azerbaijani citizenship or look for another place to live.

What is happening in the unrecognized republic, which has been under blockade since December last year, how are people surviving after June 15, when Baku banned the import of all types of humanitarian goods into NK? How do locals represent their future in current circumstances?

The questions were answered by three women from Nagorno Karabakh.

“I have six minor children. The youngest was born during the blockade, on February 11th. It was a tough time. So much stood in crushes in queues that I did not know if I could give birth to a normal child. Fortunately, my baby was born healthy.

He is already six months old. He is artificially fed. I have two days of formula left, I don’t know what I will do next. The pharmacies are empty, there is no baby food or medicines.

Until mid-June at least some products arrived, now nothing. Most people don’t have sugar, salt, pasta or vegetable oil in their homes. I used the last drops today.

It is good that the harvest of vegetables has ripened. Cooking beans, potatoes, zucchini. We stand in line for hours for bread and vegetables. Moreover, you can stand for three, four, five hours and maybe products will run out.

Before the birth of the baby I worked in a state institution and in cosmetology, but I lost my job with the blockade. I was forced to work in a bakery in order to earn money.

Friends from Armenia transfer money, but everything is expensive. Money is running out, although you do not buy anything special.

My husband was in Armenia when the blockade began. In those days, I could go to him – for a family reunion, but I stayed, realizing what difficulties there could be.

The children at first blamed me for staying here. They asked: “Do you love your homeland more or us?” It took time for them to understand: in any situation you need to fight, not run. The strong don’t run.

The school year is about to start, but I won’t be sending the kids to school. How can a hungry child go to school and understand something?

Recently, cases of fainting on the streets have become more frequent – both adults and children.

There are many problems. But we are unanimous that not a single vehicle should enter Artsakh through Aghdam, neither under the guise of humanitarian cargo, nor under any other. There should be a road connecting with Armenia.

My hope is for the Armenians living in Armenia and abroad. I hope everyone will put aside personal interests and unite. If we lose this piece of our homeland, the next [loss] will be Armenia.

Our fathers and grandfathers defended our homeland for so many years not in vain. Thousands of young men died for Artsakh. They sacrificed their lives for us to leave our homeland and flee to other countries for a piece of bread, in search of a good life? Who will I be in a foreign land?

Diplomats and representatives of international structures accredited in Armenia got acquainted with the situation on the ground in Kornidzor, where a convoy with humanitarian cargo has been standing since the evening of July 26

My youngest son is three years old, middle son is four, and oldest son is ten. The eldest, Karo, has several chronic diseases: epilepsy, diabetes, thyroid problems.

He periodically needs to undergo treatment, for which he is often forced to turn to doctors in Yerevan. There are no specialists here.

During the blockade, thanks to the Red Cross my son and I traveled to Armenia three times for treatment and returned. Knowing the situation, each time in Yerevan I bought a little more medicine for my child. I thought while we use it, the Lord will send something.

Many people say to me: “Knowing Karo’s problems, why did you come back and didn’t stay in Armenia?” It has always been difficult to get the medicines necessary for my son here, now they are simply not available.

When there are no drugs, epilepsy attacks become more frequent, the child becomes uncontrollable. And with sharp fluctuations in blood sugar, he loses consciousness and falls into a coma.

During a press conference, the Prime Minister of Armenia stated that the government is in no hurry to apply to the UN Security Council to consider the situation in NK, since the result is more important than the fact of holding hearings

At that time, he himself noticed one of the medicines he needed on one of the back shelves of the pharmacy. He screamed with joy. “Mommy, I found my cure, my life will last another 10 days.”

It is difficult, but we try to survive like a tough nut.

We only have a lot of watermelons. Dairy products are virtually non-existent. There is only one place and there are terrible queues. First you need to go and sign up, and the next day stand in line to buy.

Only expensive whiskeys and spices remained in the shops. And what should I cook with spices?

Today in Nagorno-Karabakh there is a struggle for survival. The world does not believe that there is famine, but there is. Today there are still tomatoes, but in a month they will be gone.

We are all Armenians, residents of both Armenia and Karabakh. The Armenian people must stand up, we must try together to find a way out of the current situation.

I was born and live in the Republic of Artsakh. I am 25 years old, I am married, I have a daughter of one and a half years, we will soon have twins.

From the first day of the blockade, there were queues everywhere. As a pregnant woman, they mostly give way to me. But others have to stand for hours. Fainting often happens in lines. People are malnourished, can’t stand in line in the heat.

All pregnant women have beriberi, because until recently there were no fruits and vegetables. I’m lucky with my relatives who grow things.

No gasoline to go to the hospital. Fortunately, there is an electric car owner who helps pregnant and sick people get there.

Pharmacies are completely empty, there is no baby food, many babies need formula. My daughters are due in a few days. I don’t even want to imagine what would happen if I faced this problem as a mother.

At the beginning of the blockade, it was possible to leave and spend the pregnancy in a more relaxed atmosphere. But I didn’t want to.

Even now, when the situation has become worse, I do not intend to leave her homeland. Here we are at home, we are happy despite the difficulties. Everything can be overcome, if only there is peace.

Residents of NK were left alone with their worries and problems. But we want to appeal to everyone who has the opportunity to somehow influence this situation. Help us. Today we need everyone’s support.

We are all waiting for the world to recognize our right to self-determination, for the international community to force the opening of the Lachin corridor so that ties with mother Armenia can be restored.

All residents of NK are against the movement of goods and people along the Aghdam road. We do not need a humanitarian corridor, but a full-fledged road along which we can move freely. The use of the Aghdam road is the path to integration, we are against it.

I really hope that all this will end one day and we will remember these times as a very bad dream.

Demonstrators in Nagorno-Karabakh’s Stepanakert city gathered outside the International Committee of the Red Cross (ICRC) mission’s office to protest against what they described as the ICRC’s "inability to guarantee the safety" of Nagorno-Karabakh residents while carrying out its functions because of Azerbaijan’s actions.

State Minister of Nagorno-Karabakh Gurgen Nersisyan, Human Rights Defender Gegham Stepanyan, and the family of the man who was kidnapped on Saturday by the Azeri border guards while being evacuated by the ICRC for healthcare reasons were among the participants of the rally.

Nersisyan met with an ICRC representative and said that the organization ought to publicly state that because of Azerbaijan’s actions it is unable to guarantee the safety of the residents of Artsakh while carrying out its functions. “We want you to note that you are unable to ensure the safety of any of the residents of Artsakh. You ought to announce in all European platforms that this is how the safety of the Artsakh people is ensured, when even an organization trusted by all countries across the world is unable to keep our citizen in its vehicle bearing the Red Cross emblem. You are even unable to guarantee our citizen’s life in their [Azeri] prisons,” Nersisyan said, adding that the ICRC ought to also publicly state the impossibility of coexistence of the Artsakh people with Azerbaijanis, because Azerbaijan could make false accusations against anyone who was born in Artsakh, like it did in case of 68-year-old Vagif Khachatryan, the man who was kidnapped by Azeri border guards while being taken to a hospital by the Red Cross.

ICRC Stepanakert staff told the demonstrators that they realize the difficult situation and diligently continue their work in this direction.

The demonstrators said they’ll wait for the ICRC to issue the statement.

Armenpress: Serj Tankian, other show biz stars call for intervention as humanitarian crisis in Nagorno Karabakh worsens

YEREVAN, JULY 25, ARMENPRESS. System of a Down frontman Serj Tankian has drafted an open letter calling on Azerbaijan to open the Lachin Corridor and end the oppression of the people of Nagorno-Karabakh.

The letter is also signed by musicians such as Peter Gabriel, Roger Waters, Tom Morello, and Stewart Copeland, Arsinee Khanjian as well as other notable entertainment industry figures.

In an interview with SPIN, Tankian said that more than 120,000 people are without critical food and medical supplies due to Azerbaijan’s seven-month blockade of the Lachin corridor, the only road connecting Nagorno-Karabakh to Armenia.

“The residents of Nagorno-Karabakh have since relied on humanitarian aid from Russian peacekeeping forces and the Red Cross,” reads the letter. “Azerbaijani soldiers are now blocking the entry and exit of aid convoys and the humanitarian crisis is worsening. In shops, essential food items are running out. Hospitals have an acute shortage of drugs and medical supplies. In February, the [United Nations’] top judiciary body, the ICJ [International Court of Justice], ordered Azerbaijan to ensure free movement on the road. Azerbaijan continues to ignore the ruling. We, the undersigned, join Amnesty International and the UN’s International Court of Justice in calling upon the government of Azerbaijan to open the Lachin corridor to all movement and cease the from the oppression of the people of Nagorno-Karabakh.”

“Everyone is supporting opening the blockade, from the United States to the State Department to the European Union, but it’s all talk,” Tankian told SPIN. “But while people are starving, telling a dictatorial regime to open up an illegal blockade is not going to help them survive. They’re just words. There’s no actions, and that’s the issue. Everyone has already condemned it, but no one is doing anything. For example, USAID [United States Agency for International Development] could easily tell Azerbaijan, we’re going to fly in supplies. They have an office in Armenia, and the Armenian government has supplies that have been sitting around. We’ve been trying to reach out to [USAID administrator] Samantha Power to get her attention on the issue, and she’s aware of it, because she posted about it on Twitter.”

“Most people read about Ukraine everyday in the press but don’t know that this is even happening,” Tankian says of the Nagorno-Karabagh crisis. “[Ukrainian president] Volodymyr Zelenskyy on Twitter praised Azerbaijan and their corrupt, fascist dictatorial leader Ilham Aliyev for helping Ukraine with energy supplies. So be it, but at the same time, the same dictatorial leader has put a chokehold on these people in Armenia and has invaded our proper, United Nations-recognized territories. He’s taken about 150 kilometers and his soldiers aren’t backing up. We’re being hypocritical as an international community, because we can’t sacrifice one country for another. It’s not right.”

Lachin Corridor, the only road connecting Nagorno Karabakh with Armenia and the rest of the world, has been blocked by Azerbaijan since late 2022. The Azerbaijani blockade constitutes a gross violation of the 2020 Nagorno Karabakh ceasefire agreement, which established that the 5km-wide Lachin Corridor shall be under the control of Russian peacekeepers. Furthermore, on February 22, 2023 the United Nations’ highest court – the International Court of Justice (ICJ) – ordered Azerbaijan to “take all steps at its disposal” to ensure unimpeded movement of persons, vehicles and cargo along the Lachin Corridor in both directions.  Azerbaijan has been ignoring the order ever since. Moreover, Azerbaijan then illegally installed a checkpoint on Lachin Corridor. The blockade has led to shortages of essential products such as food and medication. Azerbaijan has also cut off gas and power supply into Nagorno Karabakh, with officials warning that Baku seeks to commit ethnic cleansing against Armenians in Nagorno Karabakh. Hospitals have suspended normal operations and the Red Cross has been facilitating the medical evacuations of patients.

military service on grounds of conscience. Initially jailed, he is now
halfway through a one-year suspended sentence. He is considering an appeal
to the European Court of Human Rights, which found in favour of seven
conscientious objectors jailed or given suspended sentences earlier. The
ECtHR judgments "called for legislative action on civilian service as an
alternative to military service". No draft Alternative Service Law has been
presented to Parliament.

Convicted and jailed after refusing compulsory military service on grounds
of conscience, Jehovah's Witness Seymur Mammadov failed to have his
conviction and punishment overturned in his final appeal at Azerbaijan's
Supreme Court on 8 June. The 23-year-old Mammadov – who spent nearly 12
weeks in jail and is now in the middle of one year's probation after his
jail term was changed to a suspended sentence - is now considering a case
to the European Court of Human Rights in Strasbourg.

The European Court of Human Rights (ECtHR) has already found that the
regime violated the human rights of seven Jehovah's Witnesses who had
refused compulsory military service on grounds of conscience and sought in
vain to do an alternative civilian service. The ECtHR issued its most
recent judgments – in the cases of Emil Mehdiyev and Vahid Abilov – in
October 2021 (see below).

Although the regime paid the compensation specified by the ECtHR in 2019 to
the first five conscientious objectors, the Council of Europe is not
satisfied that the judgment has been fully implemented. "The Court pointed
out that such a situation in principle calls for legislative action by the
respondent State in order to fulfil its obligations to enable the
applicants and other persons in the same situation to benefit from the
right to conscientious objection" (see below).

In a report on Azerbaijan made public on 21 June 2023, the Council of
Europe's European Commission against Racism and Intolerance (ECRI) reminded
the regime of ECtHR judgments that "called for legislative action on
civilian service as an alternative to military service in Azerbaijan" (see
below).

No draft Alternative Service Law has been presented to the Milli Majlis and
no draft Law is listed for future consideration on the Milli Majlis website
(see below).

ECRI noted that the regime had informed it that a Working Group had been
formed in the Milli Majlis (Parliament) to draft an Alternative Service
Law. Zahid Oruj, chair of the Milli Majlis Human Rights Committee, and
parliamentary assistants were unable to give Forum 18 any information about
the Working Group, including who is on it and if it has made any progress
in drafting such a Law (see below).

Forum 18 asked Chingiz Asgarov, the government agent to the ECtHR, what
steps Azerbaijan is taking to complete its execution of this ECtHR
decision. Forum 18 received no immediate response (see below).

Forum 18 again wrote to the Human Rights Ombudsperson's Office in Baku
asking what action it is taking (if any) to ensure that Azerbaijan
introduces a civilian alternative service for those unable to serve in the

effectively promotes protection for all human rights, including in response
to credible allegations of human rights violations having been committed by
government authorities".)

Council of Europe obligation ignored

Military service of 18 months (12 months for those with higher education)
is compulsory for all young men. Article 76, Part 2 of Azerbaijan's
Constitution declares: "If the beliefs of citizens come into conflict with
service in the army then in some cases envisaged by law alternative service
instead of regular army service is permitted." However, no mechanism exists
to enact this provision.

Ahead of its accession to the Council of Europe in January 2001, Azerbaijan
promised

within two years of accession, a law on alternative service in compliance
with European standards and, in the meantime, to pardon all conscientious
objectors presently serving prison terms or serving in disciplinary
battalions, allowing them instead to choose (when the law on alternative
service has come into force) to perform non-armed military service or
alternative Civilian service".

Azerbaijan has never done this, and conscientious objectors to military
service have been repeatedly prosecuted and even jailed under Criminal Code
Article 321.1. This states

lawful grounds of call-up to military service or of mobilisation, with the
purpose of evading serving in the military, is punishable by imprisonment
for up to two years [in peacetime]".

United Nations (UN) human rights bodies, as well as the Council of Europe's
Venice Commission and its European Commission against Racism and
Intolerance (ECRI), have repeatedly criticised Azerbaijan's failure to
introduce a civilian alternative to compulsory military service (see
below).

own proposal for the text of an Alternative Service Law to try to put the
issue on the public agenda. "We have had no response to our proposal from
official people," Jafarov told Forum 18 in April 2020

Jehovah's Witness Royal Karimov was seized and handed over to the army on
25 July 2022 – two days after his 18th birthday - despite telling
conscription officials in Gadabay, the police and personnel in the military
unit that he cannot perform military service on grounds of conscience but
is ready to perform a civilian alternative service. He was finally released
from the military unit in Ganca

 ) on 1 November 2022,
more than three months later.

On 29 November 2022, Karimov received official documentation from the State
Service for Mobilisation and Conscription confirming that he is medically
unfit for military service and giving the date of 14 October 2027 for his
next medical examination. On 30 November 2022, Karimov filed an
administrative complaint about the way he had been treated to the head
office of the State Service for Mobilisation and Conscription, Jehovah's
Witnesses told Forum 18.

More than ten other Jehovah's Witness young men have faced summonses, often
repeated medical examinations and restrictions

 ) (including bans on
leaving Azerbaijan) after telling the State Service for Mobilisation and
Conscription that they cannot perform compulsory military service and that
they are willing to perform an alternative, civilian service. At least one,
who did not know he was banned from leaving Azerbaijan, was stopped on the
border with Georgia in 2019 and sent back. He is still banned from leaving
Azerbaijan.

Supreme Court upholds conviction for refusing military service on grounds
of conscience

At the Supreme Court on 8 June 2023, Jehovah's Witness Seymur Afqan oglu
Mammadov (born 16 August 2000) lost his final appeal against his conviction
and punishment for refusing military service on grounds of conscience.

Mammadov – who is from the north-western district of Goranboy – was
summoned in May 2022 by Goranboy District State Service for Mobilisation
and Conscription. He informed officers about his religious position as a
conscientious objector to military service who is ready to perform civilian
alternative service, as provided for by the Constitution and the decisions
of the European Court of Human Rights. He was subsequently informed that he
had been restricted from leaving the country.

On 22 September 2022, Goranboy District Court sentenced Mammadov under
Criminal Code Article 321.1

imprisonment. He was taken to prison, where prison officials would not let
him have a Bible or receive letters, Jehovah's Witnesses told Forum 18. He
appealed against his sentence.

Mammadov was brought to Ganca Appeal Court for the final hearing on 12
December 2022. The prosecutor stated that he supported the decision of
Goranboy District Court but, given Mammadov's age and positive character
references, he requested a two-year suspended sentence. The court partially
satisfied the appeal and replaced the nine-month jail term with a one-year
suspended sentence

Mammadov was released in the courtroom immediately after the hearing after
nearly 12 weeks in jail. His probation of one year was deemed to begin on
12 December 2022 and he has a criminal record.

Mammadov's final appeal was registered at the Supreme Court in Baku on 14
January 2023, according to court records. Officials fitted him with an
electronic tag on 16 January, Jehovah's Witnesses told Forum 18.

On 8 June, a panel of three judges at the Supreme Court in Baku, chaired by
Judge Ilkin Rajabov, heard Mammadov's final appeal against his conviction
and punishment.

"The accused was repeatedly summoned to the State Service for Mobilisation
and Conscription and Prosecutor's Office and arrived at the place where he
was called quickly every time, he never tried to avoid military service by
running away or hiding, he simply asked the authorities to provide him with
the opportunity to undergo alternative civilian service in compliance with
the internal and international obligations assumed by the state," the
defence noted in court, according to the decision seen by Forum 18. "The
accused should not be punished because there is no alternative civilian
service law."

Mammadov's defence cited the constitutional guarantees of the right not to
serve in the army on grounds of conscience, as well as those enshrined in
the International Covenant on Civil and Political Rights and the European
Convention on Human Rights. It also cited the European Court of Human
Rights judgments in earlier cases. However, the Court rejected his
arguments, claiming that because of armed conflict over Nagorno-Karabakh
which broke out again in September 2020, "restriction of alternative
service of citizens should be considered reasonable".

The Supreme Court left Mammadov's one-year suspended sentence unchanged.

Now he has exhausted all domestic remedies, Seymur Mammadov is considering
an appeal to the European Court of Human Rights in Strasbourg, Jehovah's
Witnesses told Forum 18.

"The problem of lack of legislation on alternatives to military service in
Azerbaijan"

On 17 October 2019, in the case of Mushfiq Mammadov and others (Application
No. 14604/08

 )), the European
Court of Human Rights (ECtHR) in Strasbourg found in favour of five
Jehovah's Witnesses punished through the courts between 2007 and 2013 for
refusing compulsory military service on grounds of conscience. Four of them
had been jailed, while the fifth (Mammadov) had been given a suspended
prison sentence and a fine. The judgment covered four cases

applicants), which the Court considered together.

Although the regime paid the compensation specified by the ECtHR to the
five conscientious objectors, the Council of Europe is not satisfied that
the judgment has been implemented.

The Court "observed that the present case highlights the problem of lack of
legislation on alternatives to military service in Azerbaijan, noting that
the enactment of such a law corresponds to the commitment entered into by
Azerbaijan on its accession to the Council of Europe and stems from the
Article 76 § 2 of the Azerbaijani Constitution," the Council of Europe
notes.

"The Court pointed out that such a situation in principle calls for
legislative action by the respondent State in order to fulfil its
obligations to enable the applicants and other persons in the same
situation to benefit from the right to conscientious objection."

In such cases, the "respondent state" (in this case Azerbaijan) is required
to prepare an action plan. "An action plan is a document setting out the
measures the respondent state has taken and intends to take to implement a
judgment of the European Court of Human Rights, including an indicative
timetable for the adoption and implementation of those measures," the
Council of Europe explains.

"An action report is a report by the respondent state setting out all the
measures taken to implement a judgment of the European Court of Human
Rights and/or an explanation of why no measures, or no further measures,
are necessary."

Forum 18 asked Chingiz Asgarov, the Azerbaijani government's Agent to the
ECtHR, in writing on the afternoon of 13 July what steps Azerbaijan is
taking to complete its execution of this ECtHR decision. Forum 18 received
no response by the middle of the working day in Baku of 14 July.

ECRI renews concern over lack of alternative service, calls for
"legislative action"

Officials have given mixed signals on whether they intend to fulfil the
obligation to the Council of Europe to introduce a civilian alternative
service for those who cannot serve in the army on grounds of conscience.

In its latest report on Azerbaijan

March 2023 and made public on 21 June, the Council of Europe's European
Commission against Racism and Intolerance (ECRI) noted its continuing
concern over the situation of conscientious objectors, particularly over
those who had been jailed. It said the regime had taken "no further steps"
since ECRI raised the issue in its 2019 report

ECRI reminded the regime of the 2019 ECtHR judgment in the case of Mushfiq
Mammadov and others, noting that its implementation is still pending. It
added: "ECRI strongly encourages the authorities to consider the
observations made by the Court under Article 46 of the [European]
Convention [on Human Rights], which called for legislative action on
civilian service as an alternative to military service in Azerbaijan."

In its response to ECRI on the initial draft of the report, the regime
noted: "The working group has been established in the Milli Majlis for the
purpose of drafting the law ‘On Alternative Service'."

Is Working Group working on new Alternative Service Law?

No election in Azerbaijan – including February 2020 Milli Majlis
(Parliament) elections - has ever been found to be free and fair
(https://urldefense.com/v3/__https://www.osce.org/odihr/elections/azerbaijan__;!!LIr3w8kk_Xxm!uyP-Pl10ZtZW0_D-BRKlgZ2xylQN0XpbWrx5numesTdwM4rmMKH7O2i26xRjFrTL5Fu8TSRg2wFPlUt6KlZGn6PS7hf7$
 ) by Organisation for
Security and Co-operation in Europe (OSCE) election observers.

Despite the regime's insistence to ECRI that a Working Group in the Milli
Majlis is working on a new Alternative Service Law, Forum 18 has been
unable to find out who is on the Working Group and what progress (if any)
it has made.

No draft Alternative Service Law has been presented to the Milli Majlis and
no draft Law is listed for future consideration on the Milli Majlis
website.

Zahid Oruj, a Milli Majlis deputy who chairs its Human Rights Committee,
told Forum 18 on 11 July that the Working Group is not under his Committee.
He added that he does not have "detailed information about the latest
update of the issue. We have no details of the endeavours of the re-set up
Working Group." He referred all questions to Ziyafat Asgarov, head of the
Milli Majlis Defence, Security and Anti-Corruption Committee.

Asgarov's assistant told Forum 18 on 13 July that Asgarov is on holiday. An
assistant to the Defence, Security and Anti-Corruption Committee told Forum
18 the same day that he had no information about the Working Group. He said
that as many colleagues are on holiday, it is impossible to find any
information.

Forum 18 again wrote to the Human Rights Ombudsperson's Office in Baku on
the afternoon of 13 July asking what action it is taking (if any) to ensure
that Azerbaijan introduces a civilian alternative service for those unable
to serve in the army on grounds of conscience. Forum 18 received no
response by the middle of the working day in Baku of 14 July.

Forum 18 earlier asked the Human Rights Ombudsperson's Office the same
question. Its 10 October 2022 response, signed by chief of staff Aydin
Safikhanly, did not answer this question

On 30 March 2020, Siyavush Novruzov, a senior ruling party politician, made
a brief remark to parliament, the Milli Majlis, that an Alternative Service
Law should be adopted

Novruzov repeated the call in the Milli Majlis on 5 May 2022, according to
the record of the session. "There are people whose health allows them, but
their other views do not allow them to carry weapons," he told deputies.
"In the past, of course, our territories were under occupation. That's why
we approached it completely differently. But after we are freed from the
occupation and our territorial integrity is ensured, I think that we should
also adopt a law on alternative service."

Novruzov explained to deputies that such alternative service would be
carried out not in the military but in other parts of the economy,
including health care. However, he proposed that the individual performing
alternative civilian service serve for longer than those performing
military service. "This is how he compensates for his place," he insisted.

The right of those with conscientious objections not to be forced to take
part in military structures or activity derives from Article 18 of the
International Covenant on Civil and Political Rights (ICCPR), which
enshrines "Freedom of thought, conscience and religion". In states which
have an alternative civilian service, such service must be open to all who
object to military service on grounds of conscience and must not be
punitive
