UN court introduces provisional measures for Azerbaijan on Armenia’s request

THE HAGUE, December 7. /TASS/. The International Court of Justice (ICJ), the principal judicial body of the United Nations, obliged Azerbaijan to prevent the incitement and promotion of racial hatred and discrimination against Armenians pending a verdict on the issue, ICJ President Joan Donoghue said on Tuesday.

"In its Order, which has binding effect, the Court indicates the following provisional measures: The Republic of Azerbaijan shall, in accordance with its obligations under the International Convention on the Elimination of All Forms of Racial Discrimination <…> take all necessary measures to prevent the incitement and promotion of racial hatred and discrimination, including by its officials and public institutions, targeted at persons of Armenian national or ethnic origin," she said.

In accordance with the document, Azerbaijan shall also "protect from violence and bodily harm all persons captured in relation to the 2020 Conflict who remain in detention, and ensure their security and equality before the law" and take all necessary measures to prevent and punish acts of vandalism and desecration affecting Armenia’s cultural heritage.

The court additionally urged both parties to refrain from any action which might aggravate or extend the dispute before the Court or make it more difficult to resolve.

Armenia initiated a court proceeding in the UN International Court of Justice against Azerbaijan in accordance with the International Convention on the Elimination of All Forms of Racial Discrimination on September 14. The lawsuit states that "Azerbaijan has been subjecting Armenia to racial discrimination for decades," which included mass murder, torture and other violations. The lawsuit also demands the imposition of temporary provisional measures against Azerbaijan.

On September 24, Azerbaijan filed a counterclaim, accusing Armenia of committing discriminatory actions against Azerbaijanis, on the basis of their nationality and ethnicity. Both sides have demanded compensation and provisional measures to prevent the situation from deteriorating while the cases are being heard.

ICJ orders Armenia and Azerbaijan to prevent racial hatred, but declines specific requests

The International Court of Justice (ICJ) has ordered Armenia and Azerbaijan to prevent the incitement of ‘racial hatred’, as rulings were delivered in two opposing cases submitted by the respective countries.  The court declined the two countries’ specific requests and did not order the release of prisoners of war or the handover of landmine maps by Armenia.

The 7 December ICJ rulings often differed by only a few words. In both cases the Hague-based court ordered that Azerbaijan and Armenia ‘take all necessary measures to prevent the incitement and promotion of racial hatred and discrimination’ — in Azerbaijan’s case ‘including by its officials and public institutions’, and in Armenia’s case ‘including by organisations and private persons on its territory’ — against Armenians and Azerbaijanis, respectively. 

The status of sites of Armenian cultural heritage in Azerbaijan was also covered by the court’s ruling, which ordered Azerbaijan to protect such places from ‘vandalism and desecration’ and ‘punish’ perpetrators.

The court also called on both countries to ‘refrain from any action which might aggravate or extend the dispute before the Court or make it more difficult to resolve’.

The ICJ did not rule according to the specific requests made by Armenia and Azerbaijan. While it ordered Azerbaijan to ‘protect from violence and bodily harm’ all Armenian prisoners of war, and to ‘ensure their security and equality before the law’, it stopped short of ordering their release.

‘Armenia has not placed before the Court evidence indicating that these persons continue to be detained by reason of their national or ethnic origin’, the ruling reads.

At the same time, the court also did not issue any order to Armenia prohibiting the use of landmines or necessitating that it hand over landmine maps to Azerbaijan. Azerbaijan’s legal team has argued that Armenia had used landmines as ‘a longstanding campaign of ethnic cleansing’. 

The court ruled that Azerbaijan did not provide evidence that proved that Armenia’s use of landmines has  ‘the purpose or effect of nullifying or impairing the recognition, enjoyment or exercise, on an equal footing’ of the rights of Azerbaijani ethnicity or nationality. 

Government officials in both countries declared that the rulings vindicated their respective positions. 

Following the publication of the Court’s decisions, the Azerbaijani Foreign Ministry issued a statement in which they said that Azerbaijan is ‘committed to its obligations under international conventions’ and that it ‘will continue to demand that Armenia be held accountable for violations of international law’. 

The Armenian Foreign Ministry, meanwhile, stated that ‘Armenia will consistently pursue Azerbaijan’s compliance with the Court’s orders, and will inform the Court of any violation’.

Members of European Parliament welcome ICJ’s orders

Members of the European Parliament welcomed the Orders of the International Court of Justice of 7 December 2021 indicating provisional measures in the cases between Armenia and Azerbaijan concerning the application of the International Convention on the Elimination of All Forms of Racial Discrimination.

In a statement Marina Kaljurand (S&D, Estonia), Chair of the European Parliament’s delegation for relations with the South Caucasus; Andrey Kovatchev (EPP, Bulgaria), the European Parliament's Standing Rapporteur on Armenia; Željana Zovko (EPP, Croatia), the European Parliament's Standing Rapporteur on Azerbaijan, urged Azerbaijan to immediately release the Armenian prisoners of war.

“These are important decisions with binding effect that need to be fully implemented. Furthermore, we continue urging the immediate release of all remaining prisoners by Azerbaijan, as well as the exchange of all available information on minefields in order to proceed with effective demining. In this respect, we welcome the recent release of 10 Armenian prisoners and the handing over of mine maps.

As mentioned in our previous statements, it is crucial that Armenia and Azerbaijan take immediate and effective steps to de-escalate the situation and cease any inflammatory rhetoric in order to start building mutual trust, foster reconciliation and resume negotiations on the settlement of the conflict. In this respect, we look forward to a constructive meeting between the two countries’ political leaders in the side-lines of the Eastern Partnership Summit scheduled on 15 December 2021.

Finally, we reiterate once again the EU’s commitment to support confidence-building measures and substantive negotiations, in particular on a lasting conflict settlement and the future status of the Nagorno Karabakh region within the process led by Minsk Group Co-Chairs”, the statement says.

The Armenian Government carried out daily work for the return of Armenian captives illegally detained in Azerbaijan, and this issue is discussed in all negotiations, ARMENPRESS reports Prime Minister of Armenia Nikol Pashinyan said during the parliament-Cabinet Q&A session, referring to the question of MP Artsvik Minasyan from “Armenia” bloc.

Minasyan also noted that they initiated a discussion on the issue of the POWs, and officially invited PM Pashinyan, but the latter did not participate.

“First, let me bring the freshest example, when our Government raised the issue at the International Court of Justice. I think that the court made a very important record. Of course, the court did not demand the immediate release of prisoners of war, hostages or other detainees for one reason only – absence of any _expression_ of purely racial discrimination, but on the other hand stated that those captured during hostilities should be repatriated under international law. As for the rest, we do daily work through diplomacy, the issue is discussed in all negotiations, we make all efforts”, Pashinyan said.

The Prime Minister reminded that talks are planned in the near future, meaning the scheduled meeting with Azerbaijani President Ilham Aliyev in Brussels on December 15. And he, in response to the opposition's proposal, offered to meet behind closed doors after December 15 to clarify all the issues.

Cleveland Ballet gives new hope to Armenian family of dancers

CLEVELAND — The Cleveland Ballet is back on stage. That's good news for dancers and audience members alike. And it's a life changing decision for an Armenian family who now is sharing their talent with Cleveland.

The ballet “Don Quixote," performed in 2 acts, marked the Cleveland Ballet’s long-awaited return to Playhouse Square. On stage was husband and wife Narek Martirosyan and Albina Ghazaryan and their nephew Emmanual Martirosyan. The family of Armenian professional dancers were with the New Jersey Ballet when the pandemic hit, shutting down live performances.

“Our ballet career actually doesn’t like when you stop. Every single day counts,” remarked Albina Ghazaryan.

“I was thinking about stop dancing and doing something else,” said Narek Martirosyan.

“I thought I wasn’t going to dance anymore because everything was shut down. I became a full-time teacher basically,” added Emmanual Martirosyan.

The three were teaching dance over Zoom, hoping to get back on stage. They felt time was running out for their dancing careers. That's when Narek saw a social media post about auditions in Cleveland.

“And then I saw the post. Looking for dancers and I saw this opportunity,” said Narek.

A Zoom meeting with the Cleveland Ballet produced an instant connection.

“The feeling that I knew them for a very long time helped me make the decision to come here,” said Narek.

In August, the trio came to Cleveland for a formal audition, which coincided with Albina’s birthday.

“The way our company meet us and sang for me the birthday song, it was the best thing every. And the cake, they had a cake for me with my name on it. It was very touching honestly,” said Ghazaryan as she smiled.

The auditions were a success, so the family moved to Northeast Ohio where they made their debut over the summer. They also danced in Vermillion, home of the company's summer residency.

Those first performances helping to ease some of the stress and emotional turmoil of the last year and a half.

“I enjoy dancing with my wife because I know anything I do wrong, she can fix it on the stage. I’m dancing and I feel I have her support,” said Narek.

“I defiantly know from wherever I run and jump he is going to catch me,” added Ghazaryan.

The family are on stage again for “The Nutcracker." They're thankful this holiday season for a new home and a new, extended family.

"Since the first day I walked in here, everybody was just super friendly, super welcoming, I felt I know these people for a long time," said Emmanual.

“The Nutcracker” at Playhouse Square’s Connor Palace runs from Friday, December 3rd to Sunday, December 5th.

Pashinyan reminds Aliyev about Armenian POWs

Prime Minister of Armenia Nikol Pashinyan does not agree with the statement of the President of Azerbaijan that all the points of the November 9, 2020 trilateral statement, except for the unblocking of the regional communications, have been fulfilled, ARMENPRESS reports PM Pashinyan said during the trilateral meeting with the Presidents of Russia and Azerbaijan in Sochi.

Addressing Russian President Vladimir Putin, Nikol Pashinyan reminded that they have repeatedly discussed the issue of Armenian prisoners of war and other detainees kept in Baku during personal meetings and telephone conversations. The Armenian PM noted that it’s a very important issue.

"But I want to say that we have gathered today not only to raise the issues, but to discuss their solution. I have also stated many times that Armenia is ready to start the process of delimitation and demarcation. The issue of unblocking, opening of transport and economic communications is also very important for us. We are sincerely interested in resolving these issues”, PM Pashinyan said.

Putin Meets With Armenia And Azerbaijan Leaders Over Ceasefire; Calls It ‘constructive’

President of Russia Vladimir Putin on Friday brokered trilateral talks between President of the Republic of Azerbaijan Ilham Aliyev, and Prime Minister of the Republic of Armenia Nikol Pashinyan in Sochi on the anniversary of the signing of ceasefire and ending hostilities in the Nagorno-Karabakh conflict on November 9, 2020. The talks, according to the Russian government’s press statement, entailed the progress in implementing the earlier agreements between the two warring sides to establish peace and strengthen stability. The Russian leader also mediated the negotiations for the restoration and development of bilateral trade, economic, and transport links in the Nagorno-Karabakh region. After the crucial meeting, President Vladimir Putin, Ilham Aliyev, and Nikol Pashinyan issued an official statement about the outcome of the trilateral talks. 

“We reaffirmed our agreements on the ceasefire and restoring normal life later in January. A lot has been accomplished during this time. Unfortunately, not every issue have been settled yet," said Putin. 

Putin expressed regrets about the tragic military conflict that unleashed at the volatile border, as he lamented the casualties, adding that Russia would ensure that such incidents are avoided in the future. President Putin promised to return over 53,000 war-displaced civilians from the Nagorno-Karabakh back to their permanent place of residence. Furthermore, Putin assured that no large-scale hostilities will take place between Armenia and Azerbaijan, as he will dispatch a monitoring group to work collaboratively with a contingent in Nagorno-Karabakh.

Russia and Turkey operate a joint centre in the Nagorno-Karabakh region that was opened to observe a ceasefire after last year’s flare-up of hostilities. The centre was officially established in November 2020 in the Agdam region of Azerbaijan with 60 servicemen each from Moscow and Ankara. Russia also created a trilateral commission at the level of deputy prime ministers of the governments of Armenia, Azerbaijan and Moscow.

“It is not easy, but, nevertheless, this work is at an advanced stage, and there is reason to believe that we will soon be able to not only confirm the work of the corresponding group on unblocking transport links, but also make the appropriate decisions that everyone needs,” said Russian President Putin.

The revival of the conflict-ravaged region is at the center of the goal of the Russian efforts, Putin stressed, so that both the warring sides can engage in economic activity once again. Since Russia’s mediatory efforts, no serious incidents or deliberate provocations in the Nagorno-Karabakh region have been witnessed, the President of the Republic of Azerbaijan Ilham Aliyev told the conference in Moscow. The situation has remained stable in the zone of responsibility of the Russian peacekeepers. 

Tensions over the contended South Caucasus piece of land have worsened over the past several years with Armenia and Azerbaijan blaming each other over who instigates and flares the regional conflict.  While both the Transcaucasian countries have held 'substantive' talks brokered by Putin, reports of fresh clashes emerged just hours after a ceasefire came into force. Armenia, Azerbaijan, and Russia had signed an agreement to end the military conflict, and  Russia's defense ministry flew 1,960 Russian peacekeepers from an airbase at Ulyanovsk to be deployed on the front line to guard the Lachin corridor.  However, as early as last week, troops on both sides clashed violently on the Nagorno-Karabakh border resulting in 15 military casualties on the Armenian side and two from Azerbaijan.

Artur Vanetsyan: Nikol, don’t be afraid of me but the consequences of the disaster you brought to our country

The Head of opposition "With Honour" faction Artur Vanetsyan has published on his Facebook page communication received from Apple .

The letter says that Vanetsyan is being targeted by state-sponsored attackers who are trying to remotely compromise the iPhone associated with his Apple ID. In Vanetsyan's words, he has decided to publish the letter for two reason. 

"This letter confirms my previous statements that for a long period Armenia's acting authorities had been unlawfully attempting to  eavesdrop on my cell phone conversation, violating my right to private and family life which are evidently connected with my political activity. Apple also shares tips to secure my phone which are worth to share with others. I also call the attention of the Human Rights Defender on this unlawful action against me and possible other citizens of the Republic of Armenia," Vanetsyan wrote.

"Nikol, don't be afraid of me but the consequences of the disaster you brought to our country," Vanetsyan wrote.
