RFE/RL – Kocharian Freed Pending Trial (UPDATED)

մայիսի 18, 2019

Armenia – Former President Robert Kocharian waves to supporters during his trial in Yerevan, May 15, 2019.
A court in Yerevan on Saturday ordered Armenia’s former President Robert Kocharian released from prison pending the outcome of his and three other former officials’ trial on coup charges.

Announcing the decision, the judge presiding over the trial, Davit Grigorian, cited written guarantees of Kocharian’s “adequate behavior” which were signed by the current and former presidents of Nagorno-Karabakh during a court hearing on Thursday.

Kocharian, who governed Armenia from 1998-2008, was set free about an hour later, according to his lawyers.

The trial prosecutors said they will appeal against the judge’s decision which sparked jubilant scenes among Kocharian supporters present in the small courtroom. The latter included his two sons.

The younger son, Levon Kocharian, said his father’s release from custody was “somewhat expected” for him. “The process is not over,” he told reporters. “The main parts are still to come.”

Hundreds of other backers and critics of the 64-year-old ex-president demonstrated, meanwhile, outside the court building in the city’s Nor Nork district. Riot police deployed additional forces there to keep the two rival groups apart.

The first four preliminary sessions of the closely watched trial, which began on May 13, focused Kocharian’s and his lawyers’ demands for his release from custody. The prosecution led by Armenia’s Prosecutor-General Artur Davtian objected to them, saying that the defendant could obstruct justice and even flee the country if freed.

Kocharian dismissed the objections, arguing that he flew back from Europe shortly after being summoned for interrogation in June last year.

Kocharian was first arrested and charged in July with overthrowing the constitutional order in the wake of a disputed presidential election held in February 2008, two months before he served out his second and final presidential term.

The Special Investigative Service (SIS) says that he illegally used Armenian army units against supporters of his predecessor and main opposition candidate Levon Ter-Petrosian, who protested against alleged electoral fraud. Kocharian denies the accusation as politically motivated.

Eight protesters and two police officers were killed in street clashes that broke out in central Yerevan late on March 1, 2008. Citing the deadly violence, Kocharian declared a state of emergency and ordered army units into the capital on that night. Nobody has been prosecuted in connection with those deaths.

The same coup charges were also leveled against Kocharian’s former chief of staff Armen Gevorgian and two retired top army generals, Seyran Ohanian and Yuri Khachaturov. The three men, who have not been held in pre-trial detention, deny them.

Earlier this year, Kocharian and Gevorgian were also charged with bribe-taking. They reject this accusation as well.

On Friday, Kocharian’s lawyers showed journalists footage of the 2008 clashes which they said exonerates their client. The Office of the Prosecutor-General responded by accusing of them of resorting to “manipulations” and putting “psychological pressure” on Judge Grigorian.

In a statement, the prosecutors also warned that they could take unspecified measures to stop the “spread of these lies generated with the help of certain media outlets and real or fake social media users.”

One of the defense lawyers, Hayk Alumian, countered on Saturday that the authorities and Prime Minister Nikol Pashinian in particular themselves have been pressuring courts dealing with the high-profile case. In particular, Alumian said that earlier in the day a parliament deputy close to Pashinian, Hayk Sargsian, urged government supporters to rally outside the court and press the judge to keep Kocharian behind bars.

Pashinian’s press secretary, Vladimir Karapetian, dismissed those claims shortly after Kocharian’s release. He said the court order showed that the Armenian judiciary enjoys “complete freedom” thanks to last year’s “velvet revolution” which brought Pashinian to power.

In a Facebook post, Karapetian also signaled Pashinian’s disapproval of that order. He said that “the old judicial system” continues to function in Armenia and to be mistrusted by the public.

Kocharian was already freed from custody in August. The Court of Appeals ruled at the time that Armenia’s constitution gives him immunity from prosecution on charges stemming from the dramatic events of February-March 2008.

Acting on prosecutors’ appeal, the higher Court of Cassation overturned that ruling in November, ordering the Court of Appeals to examine the case anew. The latter allowed law-enforcement authorities to press charges against Kocharian and again arrest him in December.

    Asbarez: Irritants XXII

    Garen Yegparian

    BY GAREN YEGPARIAN

It has been ten months since I complained about OPS (other people’s stupidity), so please bear with me on this gripe session. I also ask your forbearance regarding Wanna-Be-Sultan President Erdoğan’s prominence in my pieces of late. Among his many flaws is being an attention-whore, and I have fallen into the trap of feeding that desire. I promise to stay away from him for a while after this.

But, for now, we lead with Erdoğan. He has manipulated Turkey’s electoral system to overturn an election. What’s really outrageous about this case is that not only did his party lose (the Constantinople mayoral) election, but that loss was confirmed with a recount! Now, there will be a new municipal election there. The winning party has agreed, despite initially considering a boycott. You see, Erdoğan couldn’t stomach the reality that he has lost his strongest base of support, the city which gave him his political start. He has taken the cry-baby approach. But never fear, even though his party may still lose in the June 23 election now set, he will come out smelling like a rose. Why? Because, he will claim to have “defended the rights of the people” by battling against (in reality non-existent) election fraud. (Does that remind you of anyone else?) Then he will pompously announce that since the people have spoken “without fraud” in June, he will abide by the outcome.

Erdoğan’s been busy on more than just the electoral front when it comes to foolishness. In this example, he used Turkey’s foreign ministry as his mouthpiece. When Kourken Yanikian’s remains were transferred from California and reinterred in the Republic of Armenia, an announcement condemning this development emanated thence. You’ll remember that Yanikian was the first Armenian, back in 1973, to assassinate Turkish diplomats. The Turkish government asserted that it “constitutes a crime of promoting terrorism and it is unacceptable under any circumstance.” Hmmmmm, let’s see. How would one describe naming streets after mass murderers, in this case Talaat Pasha? Oh, yeah, how about – “it constitutes a crime of promoting genocide and it is unacceptable under any circumstance.” Have these people no shame, or are they just so tone deaf as to how ridiculous they make themselves look?

But Erdoğan’s not the only head of state with authoritarian proclivities whose temerity is endless. U.S. President Trump also fits the bill. I have long remained quiet about his antics, but the last few weeks have witnessed a crescendo of his lawlessness. He is having his minions break the law, e.g. not turning over his tax returns to congress upon its demand, as is plainly stated in the law. Others, he sends forth to misrepresent reality to shore up his support among those who like him and his policies, e.g. representing the Mueller report as an exoneration when it is obviously damning. If you need convincing, see the letter signed by current and former prosecutors, some 600 in number as of this writing, that says anyone else found to have acted in the way Trump did would have been prosecuted.

And then we have Israel’s arms sales to Azerbaijan. I understand that any country wants to make the most of the economic sectors in which it leads. Israel’s arms industry is among the best in the world. But it is also a country that knows what it means to live with neighbors whose pose a constant and serious threat. It is composed of people who have survived genocide. In these respects, it is very much like the Republic of Armenia. Israel no doubt remembers the complaints it filed when the U.S. would sell advanced weaponry to the likes of Saudi Arabia (until, of course, the two struck up an unstated alliance which eventually saw them supporting ISIS/Daesh). Under these circumstances, it is nothing short of obscene that Israel continues to arm Azerbaijan.

The final gripe is about Russia. The bit of fake news that their propaganda system generated targeting Adam Schiff and his “agreeing” with Saudi Arabia to take the latter’s money to support passage of an Armenian Genocide resolution in congress came at our, Armenians’ expense. In their haste to embarrass Schiff who is going after Trump for his dealings dealings with the Russians during the 2016 campaign, the Russians made Armenians in the U.S. look bad, too. This is unacceptable behavior on the part of a country which badly needs the Republic of Armenia as an outpost. Not that Adam Schiff deserves that kind of abuse, either, since he is simply carrying out his duties as a sitting member of the House of Representatives.

What are your gripes? Please let us all know. Some of them may spur discussion and advance the Armenian cause.

Erdogan Doubles Down At Sheridan Circle

Turkish American Steering Committee supporters taunting peaceful Armenian protesters at the annual April 24th rally for justice in 2016. This year, they have been permitted to occupy a portion of Sheridan Circle, site of the May, 2017, Erdogan-ordered attack on peaceful protesters.

WASHINGTON—Washington, DC-based allies of Turkish President Erdogan are doubling down on his May, 2017, attack at Sheridan Circle, attempting, once again, to prevent Americans from exercising their Constitutional right to freedom of _expression_.

The Turkish American Steering Committee (TASC) – taking a page from the playbook of the Westboro Baptist Church and neo-Nazi marchers in Charlottesville – is gaming America’s First Amendment, not to express its own views, but rather to obstruct the free _expression_ of U.S. citizens set to gather this April 24th at 4:30 pm in Washington, DC’s Sheridan Circle to protest Ankara’s denial of the Armenian Genocide.

TASC has a track record of using loud dance music, songs, shouting, and even air-horns to drown out speakers at annual April 24th demonstrations. This year they have, for the first time, secured the approval of the U.S. National Park Service to engage in their disruptive activities from an area adjacent to the Armenian Genocide protest, within the actual confines of Sheridan Circle. This traffic circle, across the street from the Turkish Ambassador’s residence, is infamous internationally as the site where, less than two years ago, Turkish President Erdogan’s bodyguards brutally beat peaceful American protesters. TASC Co-Chairman Gunay Evinch is among the lawyers hired by the Turkish Government to defend it in a lawsuit brought by victims of this attack.

The organizer of the Armenian Genocide protest – the Armenian Youth Federation (AYF) Ani Chapter – was joined by the Armenian National Committee of America in arguing vigorously against the Park Service granting a permit for a counter-protest at Sheridan Circle, on Constitutional and public safety grounds. Over these strenuous objections, the Park Service has permitted TASC to occupy roughly a third of Sheridan Circle.

The AYF is expecting a strong turn-out from the local Armenian, Greek and Assyrian/Aramean/Syriac communities – all of whom remain undeterred in raising their voices for justice on April 24th in the nation’s capital. To support the peaceful protest, join them from 4:30pm to 6:30pm at Sheridan Circle, located at Massachusetts Ave. NW and 23rd St NW. Buses are available from Soorp Khatch Armenian Apostolic Church (4906 Flint Drive, Bethesda MD) at 3:15pm. For more information, email [email protected] or [email protected]

The ANCA will be live-streaming portions of the protest on its Facebook page.

Asbarez: Artsakh President Awards Carolann Najarian with ‘Vachakan Barepasht’ Medal

ARTSAKH—On Tuesday, April 16, Dr. Carolann Najarian received the prestigious “Vachakan Barepasht” medal from Artsakh President Bako Sahakyan. The award acknowledges her distinguished service in Artsakh—during and after the war—as field doctor, health-care advisor, humanitarian aid worker, and philanthropist.

In a private ceremony held at his offices, President Sahakyan highlighted Dr. Najarian’s exemplary patriotic work, and expressed hope that she will continue supporting Artsakh’s development.

A child of Armenian Genocide survivors, Carolann Najarian was among the first to respond to the devastating 1988 earthquake in Armenia. As president of the Armenian Health Alliance, Inc., she spearheaded medical relief efforts, making more than 50 trips to deliver medical aid to the destroyed region.

Since then, she has been an integral part of the movement to rebuild Armenia and Artsakh, leading and supporting a number of initiatives. Yesterday’s award was one of many honors she has received for her philanthropic work. They include the Humanitarian Award of Boston University’s School of Medicine Alumni Association (2004), the Ellis Island Medal of Honor (1999), the Armenian International Women’s Association Achievement Award (1997), the Haystack Award for Charity, United Church of Christ, MA (1996), and the Armenian National Committee’s Vahan Cardashian Award (2017).

Dr. Najarian was accompanied yesterday by her husband, George, along with friends and colleagues including the “Hayastan” All-Armenia Fund and the Tufenkian Foundation, which continue their ongoing efforts to develop and resettle Artsakh. Following the meeting, participants visited Stepanakert’s Renaissance Square and the Freedom Fighters Park.

This was Dr. Najarian’s first visit to Artsakh in over 12 years. Sharing her impressions, she said “I feel happy and fortunate to see Artsakh completely transformed. I see happy people who walk the streets in peace…”. Her husband George Najarian added, “Artsakh is the heart of Armenia. Artsakhtsis fought on the front-line and we – Diasporans – fought on a different front, providing financial and material support to Artsakh’s people” ․

Tufenkian Foundation representatives were honored to stand with Carolann Najarian, a trustee and valued member of the Tufenkian Foundation family, as she received this well-deserved recognition.

Armenian Church commemorates the Raising of Lazarus

    Panorama, Armenia

On the 41st day of the period of Great Lent, the Armenian Church commemorates Lazarus being raised from the dead.

Qahana.am cites the Gospel according to St. John (Jn 11:11-46) saying Lazarus was from a family loved by Jesus Christ. He was the brother of Mary and Martha, who often received Jesus. Lazarus dies after succumbing to an illness. Upon hearing that His friend has died, Christ goes to visit the family, and says to Martha, “I am the Resurrection and the Life. Whoever believes in me will live, even though he dies…” Christ asks Martha if she believes this, to which she replies, “Yes, Lord.  I do believe that you are the Messiah, who was to come into the world.” Christ, standing before the grave, commands Lazarus to come forth, and he appears, being restored to life. By doing so, Christ proves that He is, in fact “Life and Resurrection”.

The Gospel story telling about the raising of Lazarus contains the passage: “Jesus wept.” The Jews, seeing Jesus expressing grief, said: “See how much he loved him!”

The raising of Lazarus is an example of the coming resurrection of all those who have fallen asleep in Christ. The weeping of Jesus demonstrates His great love towards mankind.
