Op-ed: Can Armenia and Georgia be sanctioned for helping Russia bypass international restrictions?

Armenia and Georgia were put on the US Treasury list

Armenia and Georgia are on the list of countries through which sanctioned goods can reach Russia and Belarus.

The Financial Crime Enforcement Network (FinCEN) and the Bureau of Industry and Security (BIS) of the US Department of the Treasury also included in this list Kyrgyzstan, China, India, Mexico, Israel, Serbia, South Africa, Taiwan, Turkey, the United Arab Emirates, Kazakhstan, Uzbekistan and Tajikistan.

“To these countries, controlled goods can be legally exported as raw materials, but their further export to Russia or Belarus is prohibited. Of particular concern is equipment that can be used for military purposes”, the statement said.

Items of particular concern include equipment that can be used for military purposes: aircraft parts, sonar systems, antennas, test equipment, GPS systems, oilfield equipment.

International political scientist Grigor Balasanyan sees the risks for Armenia associated with a warning from the United States – from freezing transfers to disconnecting the country from the SWIFT system.

According to Balasanyan, the Armenian authorities should not be passively waiting for the situation to worsen, in order to take steps to correct it later, already in time trouble.

“US Ambassador Lynn Tracy should be invited to the Armenian Foreign Ministry, the Armenian side should inform her that they are concerned [with this decision]. The government should present arguments why it maintains economic activity with Russia”, the expert told JAMnews.

He says that the warning was expected, as the US and the West set the task of “surrounding Russia from all sides, not giving it loopholes to overcome sanctions.” However, Balasanyan considers it wrong to unquestioningly fulfill the desires of the United States. The expert claims: that Armenia can import and export goods if they are not prohibited:

“There is a clear list of goods fixed by Interpol, the export or import of which is prohibited. If we are talking about goods that are not included in this list, then Armenia, as a sovereign state, has the right to export and import any goods through its territory”.

In his opinion, in order to exclude Armenia from this list, Armenian lobbying organizations should actively work with the State Department. Grigor Balasanyan does not pin his hopes on the Armenian Ambassador to the US. He believes that Lilit Makunts does not have political and diplomatic experience to resolve such issues.

The political scientist emphasizes that Russia is the only direction of Armenia’s economic development today. He also reminds us that Armenia is a member of the Eurasian Economic Union, operating under the auspices of Russia. Therefore, Armenia is simply obliged to support its economic partner. According to the expert, in economic relations with its ally, “Armenia is not obliged to take into account or ask the opinion of any state”.

Political scientist, an expert on Georgia Johnny Melikyan says that the US warning is another reminder of the existence of sanctions.

“States should conduct their economic policy, understanding and remembering this. This does not mean that you should not work with Russia, you just need to be very careful and not do what is forbidden”, the political scientist told JAMnews.

He does not believe that Armenia and Georgia were included in this list “on purpose” and that the list of countries is long, and all these countries have some kind of economic relations with Russia:

“Armenia and Georgia, like all countries that have not imposed sanctions against Russia, should try to prevent the use of their territory, on the one hand, and, on the other hand, continue trade and economic relations with Moscow”.

According to Melikyan, Washington does not see the danger of exporting military equipment through Armenia and Georgia but considers Central Asia to be of “special concern” to the US Bureau of Industry and Security.

“One case has already been disclosed in the media when Motorola’s systems were transported from Georgia to Uzbekistan, and from there they got to Russia. This fact was not denied even by the director of the company. He said that, yes, they were sold, but to Uzbekistan, and not to Russia.

Deliveries to Motorola are prohibited since radio transmission systems and GPS are on the list of sanctioned goods.

If they conduct an investigation, they will determine how much the Georgian company or the Georgian government was to blame in this case. However, the fact happened. Georgia turned out to be the path that the sanctioned cargo took. Maybe in this case the law was not violated, but Georgia was involved in the scheme.

It is because of such cases that Georgia ended up on this list. This is what we know, but there could be other incidents.

If it is proved that this happens frequently, Georgia will be asked to prevent these cases.

When you sell a sanctioned cargo and deliver it to a country not associated with sanctions, and when you do not know the future fate of this cargo, you must calculate the risks and investigate. In this case, for example, it turned out that this company is actually Russian and registered in Uzbekistan.

When you export to a third country and you have no guarantee that your goods will not reach Russia, you are also being used as part of a sanctions evasion scheme.

If such cases are repeated and become systematic, it is possible that the country will be included in the sanctions list. It is possible to ban the import of sanctioned goods into Georgia.

Therefore, regardless of whether Georgia joins the sanctions or not, the country must declare that in the conditions of war it prohibits the export of dual-use goods to Russia or to countries that have no restrictions with Russia through its territory.

Otherwise, the country may actually face sanctions”.

Armenia activists stage protest on top of Mount Hatis

A group of activists in Armenia staged a demonstration on top of Mount Hatis, and expressed their protest against the initiative of Prosperous Armenia Party leader—and business tycoon—Gagik Tsarukyan and the Armenian government to build a giant statue of Jesus Christ on the mountain.

Also, they showed a video of the Bronze Age monuments that are already destroyed as a result of the construction work for the aforesaid statue.

The Ministry of Environment of Armenia had announced that the aforementioned construction on top of Mount Hatis had been stopped, and the Ministry of Education, Science, Culture and Sports had considered any construction on the mountain inadmissible.

The Armenian Apostolic Church had spoken against the installation of this statue, and urged Tsarukyan not to implement such an initiative, as it goes against the practice of the Armenian Apostolic Church.

Tsarukyan, however, did not call off the project.

And Prime Minister Nikol Pashinyan announced at Thursday’s Cabinet meeting of the government that they had received the respective documents and positively assessed the installation of a giant statue of Jesus Christ on top of Mount Hatis. According to him, this will promote tourism in Armenia.

YEREVAN, JULY 15, ARMENPRESS. Prime Minister of Armenia Nikol Pashinyan received Russia’s Minister of Transport Vitaly Saveliev and his delegation, the PM’s Office said.

During the meeting Prime Minister Pashinyan praised the intensity in the Armenian-Russian relations in the person of regular official visits which highlight the unique nature of the bilateral ties. Nikol Pashinyan attached importance to the cooperation in all directions, including in the field of transport, and also highly valued the efforts and operational response of the Russian side in solving emerging crisis situations in the Upper Lars border checkpoint.

The Russian minister conveyed the warm greetings of Russian PM Mikhail Mishustin to the Armenian PM and assessed the work with the Armenian partner agencies effective. He said that Russia is interested in developing the friendly, brotherly partnership and mutually beneficial programs with Armenia.

Views were exchanged also around the cooperation in transportation and logistics fields. The sides touched upon the aviation and road communication, public transport infrastructure, both sides highlighted exchange of experience and active inter-agency work in these directions. It was stated that the development of transportation communication will contribute to the increase in bilateral passenger and cargo transportations, will boost economic contacts and tourism ties.

Top Iranian Security Official to Visit Armenia

Shamkhani is planned to pay a visit to Armenia on Thursday, July 7, Nournews reported on Wednesday.

He will travel to Yerevan at the invitation of Secretary of the Security Council of Armenia Armen Grigoryan.

Shamkhani is scheduled to hold talks with his Armenia counterpart and with Prime Minister of Armenia Nikol Pashinyan to discuss bilateral, regional and international issues.

After the trip to Armenia, the senior Iranian security official will travel to a number of other Caucasus countries.

California’s governor signs budget with $10 million for Armenian American Museum

California Governor Gavin Newsom has signed the 2022-2023 State Budget with $10 million in new funding for the Armenian American Museum currently under construction in the City of Glendale. The new funding brings the State of California’s total investment in the cultural and educational center to $19.8 million, the museum said.

Governor Newsom first proposed the new funding for the museum in the May Revised Budget proposal for the State of California. Last week, the Governor made the additional funding official with the signing of the state budget.

“We extend our sincere gratitude to Governor Gavin Newsom for his strong leadership and unwavering support of the Armenian American Museum,” stated Executive Chairman Berdj Karapetian on the heels of the major announcement. “We also extend our special thanks to Senator Anthony Portantino for his longstanding advocacy in support of the project.”

Senator Anthony Portantino, a longtime champion of the museum, has been collaborating with the Governor’s office to educate state officials and colleagues on the historic significance of the project.

“I am deeply appreciative to Governor Newsom for proposing and signing $10 million in new state funding to support the Armenian American Museum,” stated Senator Anthony Portantino. “The Governor recognizes the major impact the institution is going to have on all Californians and once again has proven his commitment with this critical and timely investment.”

The Armenian American Museum is a world class cultural and educational institution that is currently under construction in the museum campus at Glendale Central Park. The museum will offer a wide range of public programming through the Permanent Exhibition, Temporary Exhibitions, Auditorium, Learning Center, Demonstration Kitchen, Archives Center, and more.

The museum celebrated its historic groundbreaking and commenced construction on the project in Summer 2021. The Phase I construction of the semi-subterranean parking garage and foundation is on schedule to be completed in Summer 2022. The next major phase of the project will be the Phase II construction of the two-level 50,820-square-foot museum complex.

ANCA supports Pallone-led Congressional letter to block F-16 sale; Pappas/Bilirakis NDAA Amendments

WASHINGTON—Bipartisan Congressional opposition to President Biden’s recent green-lighting of the controversial sale of U.S. F-16 fighter jets and upgrade kits to Turkey is mounting with the Congressional Armenian Caucus and Hellenic Caucus leading the charge, reported the Armenian National Committee of America.

Congressional Armenian Caucus Co-Chair Frank Pallone (D-NJ) and Hellenic American Caucus Co-Chairs Gus Bilirakis (R-FL) and Carolyn Maloney (D-NY) were joined by Greek-American Representatives Chris Pappas (D-NH) and Dina Titus (D-NV) this week in calling on their Congressional colleagues to co-sign a letter to President Biden sharing their deep concern about the support he expressed for an F-16 sale to Turkey during the recent NATO summit in Madrid, Spain.  

The Congressional letter notes, “Turkish and Turkish-backed forces have utilized American-made weaponry and components during these incursions to commit war crimes, including purposefully bombing civilian targets like hospitals and schools in Iraq, Syria, and Nagorno Karabakh. They have also been used repeatedly to violate the sovereign territory of NATO allies and partners like Greece and Cyprus. These are hardly the actions of a committed ally to the United States and Europe.”  The letter concludes by stating, “precedent shows that Erdogan will not change his behavior if we continue to reward his efforts to undermine the NATO alliance. The United States must not provide any further support to Turkey’s military until tangible steps are taken to halt his destabilizing actions and violations of international law at home and abroad.”

ANCA Executive Director Aram Hamparian welcomed this most recent Congressional effort to block the F-16 sale. “We join with our Hellenic allies and all our coalition partners in supporting Congressman Pallone’s call on President Biden to block Turkey’s purchase of F-16s – an advanced weapons system that Ankara will surely use to target, intimidate, and attack Greeks, Cypriots, Kurds, and Armenians,” stated Hamparian.  “A strong show of support for this bipartisan letter – backed up by a sustained Congressional, coalition, and community drive to impose statutory restrictions on this reckless sale – is needed to avert a foreign policy disaster – the arming of Ankara, an openly anti-American power seeking to displace U.S. leadership across a region vital to global security.”

The ANCA is working with Armenian Americans across the U.S. to secure support for the Pallone letter. Over the past month, ANCA Leo Sarkisian, Maral Melkonian Avetisyan, and Hovig Apo Saghdejian Capital Gateway Program summer interns and fellows have been joined ANCA Government Affairs Director Tereza Yerimyan and Hamparian in meetings with over 100 Congressional offices sharing concerns about the pending F-16 sale to Turkey, as part of advancing broader pro-Artsakh / Armenian community priorities.

In addition to Representatives Pallone, Bilirakis, Maloney, Pappas, and Titus, current co-signers of this most recent Congressional letter include Representatives Raul Grijalva (D-AZ), Raja Krishnamoorthi (D-IL), Nicole Malliotakis (R-NY), James McGovern (D-MA), John Sarbanes (D-MD), Janice Schakowsky (D-IL), and David Valadao (R-CA).  Additional co-signers are expected in the upcoming days.

The ANCA is also supporting two amendments – #208 and #478 – to the Fiscal Year 2023 National Defense Authorization Act (NDAA – H.R.7900) which would effectively prohibit President Biden from selling or transferring F-16s or F-16 modernization kits to Turkey.  Led by Representatives Chris Pappas (D-NH) and Gus Bilirakis (R-FL), current co-sponsors of both measures include Representatives David Cicilline (D-RI), Carolyn Maloney (D-NY), Nicole Malliotakis (R-NY), Grace Meng (D-NY), Frank Pallone (D-NJ), John Sarbanes (D-MD), Brad Schneider (D-IL), and Dina Titus (D-NV).  The House Rules Committee will determine as early as July 12th whether the amendments are “in order,” allowing a full House vote on the measures.

Earlier in the week, Representatives Carolyn Maloney, Bilirakis and Pappas issued strong statements opposing the Biden Administration’s apparent plans to sell sensitive F-16 modernization kits to Turkey.

“I am deeply disappointed with the apparent plan to move forward with modernizing Turkey’s F-16s.” said Rep. Maloney “We must not forget that Turkey uses their current air fleet to violate the sovereignty of a reliable NATO member and ally, Greece, and that such a modernized force could be used to support their illegal occupation of Northern Cyprus. Furthermore, Turkey still possesses Russian S-400 anti-air systems, which led to their ejection from the F-35 program and the imposition of CAATSA sanctions We must continue to hold Erdogan accountable for violations of U.S. law, human rights, and the security of our ally Greece – not reward him.”

Rep. Bilirakis concurred, noting, “Turkey has consistently demonstrated a complete disregard for following international law. Erdogan repeatedly acts contrary to American interests, with his dangerous behavior contributing to the instability of the region. For all these reasons, we absolutely must not sell Turkey F-16s or F-16 modernization kits.”

Rep. Pappas shared, “I’m deeply concerned about Assistant Secretary Wallander’s comments in support of modernizing Turkish F-16s and strongly oppose the sale of advanced weapons and equipment to upgrade Turkey’s F-16 fleet. Turkey has failed to address the issues that led to its ejection from the F-35 program and the imposition of CAATSA sanctions. Turkey’s increasingly belligerent rhetoric and behavior towards Greece, a reliable democratic NATO ally, also cannot be ignored. Turkish F-16s have flown over Greek islands and violated its airspace hundreds of times in recent weeks, and Turkey has launched a baseless campaign disputing Greece’s sovereignty over its eastern Aegean islands. We cannot allow the Erdogan government to escape accountability for violating U.S. law and the standards of the NATO alliance.”

In a joint statement, Representatives Bilirakis and Malliotakis remarked, “As members of the Congressional Hellenic Caucus, we remain strongly opposed to any sale of U.S. military equipment to Turkey and will continue to express our concerns to our colleagues on the House Committee on Foreign Affairs. The bond between Greece and the United States has only been strengthened over the last two centuries, and it’s incumbent upon Congress to stand together against aggression whether it comes from an adversary like Russia or a NATO ally like Turkey that continues to violate international law.”  

Rep. Dina Titus (D-NV) led a statement along with Reps. Chris Pappas, Charlie Crist (D-FL), Carolyn Maloney, Frank Pallone, and John Sarbanes outlining Turkey’s ongoing aggression against fellow NATO member, Greece.  “Since the beginning of 2022 Turkey has violated the airspace of fellow NATO ally Greece over 2,377 times, including 120 overflights over Greek territory. Turkey’s antagonistic actions in the Aegean Sea, as well as their hostile stance towards the Greek government, make it clear that they do not intend to suspend these aggressive and destabilizing actions soon,” noted Rep. Titus and her colleagues. 

In addition to the ANCA, the following U.S. civil society organizations are on the record opposing the sale of F-16s to Turkey: American Friends of Kurdistan, American Jewish Committee, Hellenic American Leadership Council, In Defense of Christians, Middle East Forum, and PSEKA – International Coordinating Committee Justice for Cyprus.

Pashinyan briefs Putin on Armenian-Turkish normalization talks

Russian President Vladimir Putin discussed security on Armenian-Azerbaijani border with Armenian Prime Minister Nikol Pashinyan, TASS reported on Wednesday, citing the Kremlin press service.

"The sides continued their discussion of practical aspects of implementation of the trilateral agreements of leaders of Russia, Armenia and Azerbaijan, achieved on November 9, 2020, January 11 and November 26, 2021. In particular, the sides had an exchange of opinions on the issues of ensuring security on the Armenian-Azerbaijani border and restoration of economic and transportation connections in South Caucasus," the press service said.

The Kremlin added that Pashinyan informed Putin about the recent contacts aimed at normalization of relations between Armenia and Turkey.

The conversation took place on Armenia’s initiative.

The Ministries of Foreign Affairs of Armenia and Serbia hold political consultations

YEREVAN, JUNE 30, ARMENPRESS. Political consultations between the Ministries of Foreign Affairs of the Republic of Armenia and the Republic of Serbia took place in Yerevan on June 30. The Armenian delegation was headed by Deputy Foreign Minister Paruyr Hovhannisyan, the Serbian State Secretary Nemanja Starović.

As ARMENPRESS was informed from the press service of MFA Armenia, recording the high-level political dialogue between Armenia and Serbia, the sides discussed the opportunities and the practical measures to deepen the friendly Armenian-Serbian relations and strengthen the interstate ties.

A number of international and regional issues were touched upon during the consultations. Reference was made to Armenia's steps aimed at establishing peace and stability in the South Caucasus region. The Armenian side stressed the need to repatriate Armenian prisoners of war, hostages and other detainees in the context of humanitarian issues resulted by the 44-day war unleashed by Azerbaijan, as well as the preservation of Armenian cultural and religious heritage in Azerbaijani-held territories.

At the end of the consultations, the Serbian delegation was received by the Minister of Foreign Affairs of the Republic of Armenia Ararat Mirzoyan. Minister Mirzoyan highlighted the mutual visits and contacts at different levels, aimed at the continuous expansion of the political dialogue between the two countries and the outlining of new directions of mutually beneficial multifaceted cooperation.

On the same day, the Serbian delegation visited the Armenian Genocide Museum-Institute, the Armenian Genocide Memorial, to pay tribute to the memory of the victims of the Armenian Genocide.

Film: ‘Sweeping Yerevan’ wins best documentary award at Ramsgate International Film & TV Festival

“Sweeping Yerevan”, a film directed by Nairi Hakhverdi and produced with the financial support of the National Cinema Center of Armenia, won the Best Documentary award at the Ramsgate International Film & TV Festival held in the UK earlier in June.

“The National Cinema Center congratulates the film’s creative team and extends our best wishes for their continued success,” it said in a statement on Friday.

“Sweeping Yerevan” is a poetic observational portrait of Marina, a woman who travels 40 km every night to sweep the streets of Armenia’s capital, Yerevan, dodging cars and putting her life at risk, in order to provide for her blind husband, live-in mother-in-law, unemployed son, and two young children. By day, she mends clothes for clients and works as a janitor at the local music school to cover the remainder of her family’s expenses. With few options for her generation since the collapse of the Soviet Union, Marina nurtures education and musical skills in her children, hoping that they will have a different future from her own.
