Armenian Ombudsman appeals to CoE Committee of Ministers regarding the return of Armenian POWs

Armenia’s Human Rights Defender Arman Tatoyan has appealed to the Committee of Ministers of the Council of Europe regarding the immediate return of all prisoners of war illegally detained in Azerbaijan.

The special report is related to the fact that on March 9, 2021, the European Court of Human Rights (ECHR) sent a public notice to the Committee of Ministers, stating that the Azerbaijani government does not meet the deadlines set by the court on prisoners, provides the court with general and limited information.

The report of the RA Human Rights Defender shows that the behavior of the Azerbaijani authorities grossly violates international requirements by presenting the captives as “terrorists” or “saboteurs.”

“All servicemen of the Armenian side and civilians were taken prisoner by the Azerbaijani armed forces in the current, ongoing armed conflict, therefore, they are all prisoners of war, they must be released immediately, returned to their homeland without any political or other preconditions,” the Ombudsman says.

The Azerbaijani authorities are artificially delaying and politicizing the process, grossly violating the rights of the prisoners and their families, causing them suffering and causing tension in the society, he says.

“It is absolutely reprehensible that the Azerbaijani authorities do not publish the real number of captives of the Armenian side illegally detained in their country. They are causing double suffering to the families of the missing, as the situation becomes more uncertain for them, and this is against the background of the fact that the Azerbaijani authorities are constantly obstructing the search and discovery of the bodies,” the Human Rights Defender says.

The absolute urgency of these issues should be considered in the context of the policy of hatred and enmity towards Armenia at the state level, he adds.

The application to the Committee of Ministers of the Council of Europe provides a detailed analysis of international human rights requirements, sets out concrete examples of human rights violations, and raises the issue of support for the immediate return of prisoners.

Along with all this, the RA Human Rights Defender specifically states that the RA state bodies and officials are obliged to provide proper communication with the families of the captives, the missing, to provide them with exhaustive information, to act systematically, as well as to pay attention to their own words for any tension.

Apprehended citizens released from Armenia’s Central Police Department

All the apprehended near Government building today have been released from Central Police Department.

“Five apprehended were kept in the Central Police Department. No other apprehended person is kept in this department,” human rights advocate Ruben Melikyan told the reporters.

Melikyan said he does not have information about the apprehended in other departments.

Azeri Vandalism to Armenian Church Incites Plea for Protection

03/29/2021 Nagorno-Karabakh (International Christian Concern) –  Recent satellite and video footage reveals the partial destruction of Shushi’s Armenian Kanach Zham Church. The city and church now remain under Azeri control. In light of the most recent damaged church, the Interparliamentary Assembly on Orthodoxy (IAO) called for the protection of Christian monuments in Nagorno-Karabakh.

Satellite photos taken four months apart, one in October 2020 and one in February 2021, show the church domes completely destroyed. Saint John the Baptist Church, also known as Kanach Zham, reportedly faced partial demolition by Azeri troops just days after Shushi came under their control.

This vandalism against Armenian Christian heritage sites adds to the list including Ghazanchetsots Cathedral of Shushi, St. Astvatsatsin Church of Mekhakavan, and others. President Alivey also identified a 12th-century Armenian church to be an Albanian church and expressed his intentions to renovate it.

The IAO Secretary General said in a statement that the Armenian Christians sites now under Azeri control required “immediate registration and protection from the international community and the competent international bodies. We therefore, call on the UN and UNESCO to contribute to the protection of the cultural wealth and monuments of the Armenian people, now under the administration of Azerbaijan and not to allow changes in their use or destruction.”

Turkish President Recep Tayyip Erdoğan reiterated his country’s firm position on following its revisionist agenda

“With this mentality, we have succeeded in Karabakh, Cyprus, the Eastern Mediterranean and the Aegean,” Erdoğan said provocatively when responding to criticism for his policies.

“Attempts that are not in line with our ethics, law, justice, goodwill and conscience, by those who do not respect Turkey ‘s sovereign rights, has and will have no value in our eyes,” he said.

The Turkish President added: “From Syria to Libya, from Karabakh to Cyprus, and from the Eastern Mediterranean to the Aegean, in every place with this mentality we have reached the success of our struggles.”

In essence, Erdoğan responded to recent criticism about the human rights situation in Turkey and their growing provocations in the Aegean and Eastern Mediterranean.

He even called his critics ” hypocrites “.

The Turkish president specifically stated:

“The purpose of imposing criteria on us, which they never apply themselves, is not to direct our country in a more modern and successful way.

“We know full well that the goal is to cause a waste of time and energy.

“From the defense industry to the energy sector, from the environment to human rights, and from politics to civil liberties, to countless other examples we have experienced, we have not thanked and will not thank these hypocrites.”

The new provocative statements of the Turkish president took place during his announcement on new COVID-19 measures in the country.

Only “surviving” Armenian church in Turkey’s Cappadocia in danger of collapsing (PHOTOS)

The Armenian Church located in Sivrihisar village of Guzelyurt district of Aksaray Province of Turkey and presumably built in the 5th or 6th century—and is now called Kizil—is constantly being destroyed by treasure hunters.

According to Akunq.net, the only “surviving” Armenian church in Cappadocia is constantly attacked by treasure hunters.

The World Monuments Fund has been put this church on its list of the 100 Most Endangered Sites in the world.


Slovak Parliament adopts resolution on Nagorno Karabakh, calls for release of POWs

During the 25th plenary session the National Council of Slovakia unanimously adopted by 120 votes in favor the resolution “On Nagorno Karabakh” submitted by Chair of the Foreign Affairs Committee Marián Kéry, (SMER-SD/Social Democrats).

The resolution strongly condemns the killings of civilians, the destruction of civilian infrastructure, monuments of cultural and religious heritage, expresses concern over the military involvement of third countries in the conflict and their destabilizing role, and emphasizes that the process of determining the future legal status of Nagorno-Karabakh should be carried out under the auspices of the OSCE Minsk Group Co-Chairs, expresses deep concern that prisoners of war and other detainees, including civilians, have not been released in accordance with the provisions of international humanitarian law, in particular the 1949 Geneva Convention.

The resolution calls on the Government of the Slovak Republic, the European Union and international organizations to ensure that all allegations of war crimes, including the use of cluster munitions, are properly investigated, that all prisoners of war and civilians are released immediately, and that international humanitarian organizations enter Nagorno-Karabakh without restrictions.

This is the second resolution on the last 44-day war unleashed by Azerbaijan against Nagorno-Karabakh adopted by the Slovak National Council. The first resolution on the ongoing conflict in Nagorno Karabakh was adopted by the National Council of the Slovak Republic on October 22, 2020.

Human Rights Watch calls for international pressure on Azerbaijan over Armenian POWs –

Azerbaijan’s international partners should press the Aliyev government to hold the perpetrators of the torture and degrading treatment against Armenian servicemen and civilians accountable, Human Rights Watch’s Deputy Director for Europe and Central Asia Rachel Denber has told Armenpress news agency in an interview. Question: During the 2020 Nagorno Karabakh War many videos posted on private Telegram accounts and groups showed Azerbaijani military servicemen humiliating, executing and committing other acts of inhumane treatment against numerous Armenian prisoners of war, including both servicemen and civilians. This is a clear violation of the third Geneva Convention which states that “prisoners of war must at all times be humanely treated … In particular, no prisoner of war may be subjected to physical mutilation … Likewise, prisoners of war must at all times be protected, particularly against acts of violence or intimidation and against insults and public curiosity. Measures of reprisal against prisoners of war are prohibited.” In your opinion, how should the international community and human rights organizations react to this kind of conduct of the Azerbaijani military?

Rachel Denber: Human Rights Watch documented cases in which Azerbaijani forces subjected POWs to cruel and degrading treatment and torture– either when they were captured, during their transfer, or while in custody at various detention facilities. We also documented cases when they abused civilians. These are serious violations of the Geneva Conventions that rise to the level of a war crime. Azerbaijan’s international partners should press the government to hold the perpetrators accountable. They should regularly request information and updates on investigations and trials. This should be done in the framework of bilateral relations with Azerbaijan and also in multilateral fora, including the UN, the Council of Europe and the OSCE.

Question: The government of Azerbaijan continues violating the 2020 November 9 ceasefire terms regarding the exchange of PoWs and other detainees. The President of Azerbaijan Ilham Aliyev falsely stated that they have returned all PoWs and claimed that the remaining Armenians in their custody are not classified as such. The Azeri government went on to initiate fabricated criminal charges against them. Meanwhile, Armenia has returned all Azerbaijani captives pursuant to the “all for all” principle enshrined in the November 9 ceasefire. How do you assess such behavior by Azerbaijan?

Rachel Denber: Human Rights Watch is not in a position to verify the claims by Azerbaijan or Armenia about the numbers of people remaining in custody or their status. Regardless of these individuals’ status in custody, Azerbaijan still has obligations to protect their rights to decent conditions in custody, and to ensure that they are not subjected to torture or other forms of cruel, inhuman, and degrading treatment.

Chair of the Delegation for relations with the South Caucasus, MEP Marina Kaljurand, the European Parliament's Standing Rapporteur on Armenia, MEP Andrey Kovatchev, and the European Parliament's Standing Rapporteur on Azerbaijan, MEP Željana Zovko, on Tuesday issued a joint statement urging Azerbaijan to immediately release all remaining Armenian prisoners. The full text of the statement is provided below.

“We are gravely concerned by numerous allegations of abuse of Armenian captives by Azerbaijan, as documented in particular in a recent Human Rights Watch report. We urge the Azerbaijani authorities to investigate all such allegations and to bring those responsible to justice. Full respect of international humanitarian law and the prohibition of torture and other degrading or inhuman treatment must be ensured.

We also deplore the fact that the Azerbaijani government has failed to comply with the interim measures of the European Court of Human Rights which ordered Azerbaijan to provide information on the conditions of detention of the detainees, their state of health, as well as the measures taken to return them.

Once again, we call on Azerbaijan to release without delay all remaining Armenian detainees, in line with the provisions of the ceasefire agreement of 9 November 2020.”

Former presidents of Armenia, Artsakh meet to discuss post-war situation in Artsakh

On March 25, Armenia's first President Levon Ter-Petrosyan met with second and thirst presidents Robert Kocharyan, Serzh Sargsyan as well as former presidents of Artsakh Republic Arkady Ghukasyan and Bako Sahakyan. 

As Ter-Petrosyan's spokesperson Arman Musinayan reported, the post -war situation in Artsakh (Nagorno-Karabakh) and issues related to possible future developments were discussed during the meeting. 

Earlier, the Office of second President Serzh Sargsyan informed that during the recent war in Artsakh and in the post-war period, meetings in the format of the former presidents is necessitated with the imperative of addressing the priorities of the vital issues Armenia and Artsakh face.
