YEREVAN, 5 NOVEMBER, ARMENPRESS.  The Constitutional Court has recognized the article that served as basis for the dismissal of the then Chief of the General Staff of the Armed Forces of Armenia Onik Gasparyan as constitutional. ARMENPRESS reports the Constitutional Court decided that the Part 3 of Article 40 of the Law on Military Service and Status of Servicemen is in line with the Constitution.

In March 2021, the President of Armenia Armen Sarkissian applied to the Constitutional Court regarding the constitutionality of the given provision of the law, twice refusing to sign the draft decree submitted by Prime Minister Nikol Pashinyan.

Sports: World Boxing Championships: Armenia’s Davit Chaloyan scores glorious victory over Azerbaijani boxer during semi-final

Armenia’s representative Davit Chaloyan, 24, scored a glorious victory during the semi-final of the 2021 AIBA World Boxing Championships and secured the title of at least runner up.

In the +92 kg category, Chaloyan faced off against two-time European youth champion, participant of Tokyo 2020, Azerbaijani boxer Mahammad Abdullayev and clearly beat him 5-0.

The Armenian boxer scored a confident victory over Abdullayev in three rounds.

On November 5, Chaloyan’s opponent will be Russian boxer Mark Petrovskii during the final.

This is the first time Chaloyan is participating in a world championship with adults.


No changes in positions at Paylasar section, PM Pashinyan reiterates

YEREVAN, OCTOBER 27, ARMENPRESS. Prime Minister Nikol Pashinyan reiterated that there haven’t been changes in the positions of border guards in the Paylasar section and that Armenian border troops are on duty in the same positions where they’ve been deployed since December 2020.

“The National Security Service Border Troops Commander explained to lawmakers here yesterday that there haven’t been any positional changes and our border guard service is conducting service in the same positions as before,” Pashinyan said during a Q&A session in parliament when asked by MP Narek Ghahramanyan.

He said that the Armenian border guards are deployed in the given section since December 2020.

Kremlin reacts to reports on trilateral Armenian-Russian-Azerbaijani summit

If an agreement on holding a Russia-Armenia-Azerbaijan summit is reached, the Kremlin will inform in due time, Russian President’s Press Secretary Dmitry Peskov told RIA Novosti.

The comments come in the wake of reports claiming that a meeting between Russian President Vladimir Putin, Armenian Prime Minister Nikol Pashinyan and Azerbaijani President Ilham Aliyev could take place in early November. It was reported that the parties were expected to sign trilateral statement.

“If such an agreement is reached, we will inform about it in due time,” Peskov said, asked whether a meeting of the leaders of Russia, Armenia and Azerbaijan was planned in Moscow in the first decade of November.

Council of Europe delegation visits Armenian Genocide Memorial

The Rapporteur Group on Democracy of the Committee of Ministers of the Council of Europe, headed by Swedish Ambassador to the Council of Europe Martin Ehnberg, visited the Armenian Genocide Memorial.

The guests were greeted by Lusine Abrahamyan, Deputy Director for Museum Works of the Armenian Genocide Museum-Institute.

The guests laid flowers at the eternal fire and observed a minute of silence in memory of martyrs of the Armenian Genocide.

They also toured the Armenian Genocide Museum and got acquainted with permanent and temporary exhibitions. At the end of the visit, Mr. Martin Ehnberg left a note in the Book of Honorary Guests.

Asbarez: Remembering Savey Tufenkian

On September 9, at UACC, I attended the funeral of a dear friend, Savey Tufenkian. Three Los Angeles Bishops performed a beautiful memorial service. It was a touching and emotional experience to hear the personal stories read by her teary eyed grandchildren.

I got to know Savey when Medical Outreach brought 14 earthquake victims ages 2-14 to Los Angeles for surgeries, and prostheses. Savey took over the care of the seven children at Centinela Hospital. She slept at the hospital as the children needed a translator, and a counselor. All fourteen children had lost one.. two and some had lost all family members to the infamous Spitag earthquake of December 7,1988 which took the lives of 25,000 Armenians..

After six months in Los Angeles, the children had received their prostheses. Savey and I took the children back to Armenia. Our plan was to bring another fourteen children who needed prostheses.

Savey and I stayed ten days in Yerevan, visited different hospitals and finally went to the Orthopedic Hospital in Nor Marash where most amputees were. With the advice of the local doctors, we decided on 14 more patients to bring to Los Angeles.

It took a week to get the children ‘s passports and then their exit visas. As soon as the formalities were done, we made the travel arrangements to fly from Yerevan to Moscow, then a stopover in New York, and then to Los Angeles.

We knew the children needed visas to enter the USA, and the only American consulate which could issue an entry visa was in Moscow. In our previous experiences, we would typically go to the American Consulate, get the visas, and stay overnight in Moscow. On this occasion, I was afraid we might have difficulty finding a hotel, and perhaps end up staying longer than overnight. If that happened, I was afraid we would miss our flight to New York creating a very painful situation for the children.

To avoid such a possibility, we decided to get the visas at the customs in Los Angeles. So we got on the plane in Yerevan and after a short stopover in Moscow we flew to New York. We arrived at the airport at 3pm. We had a two hour stay before the flight to Los Angeles.

We got into the long customs line. The people waiting were kind enough to let our children in their wheel chairs, walkers and canes go to the front of the line.

I handed my passport to the officer in the booth, then Savey handed hers and then the children with passports in their hands came forward.

The first child handed her passport. The officer went through the pages, looked at us and said, Where is her entry visa? He looked through other passports and none of the children had visas.
“We were planning to get their visas here at the customs. ” I said.
The officer shook his head and made a telephone call.
Within seconds two policeman came and asked us to follow them. We were taken to a large room where there were several other police officers.

The one officer, the captain of the group, came over and asked with a stern voice. “You mean you are bringing these children to America with no entry visas? Don’t you know no one can enter USA without a visa? “Who are these children? Where are their parents?”

“They are Armenian children, earthquake victims. “ said Savey “ We are bringing them to USA for medical treatment.”

The captain asked us to follow them to another room while the children stayed with a female officer. All of a sudden over half a dozen more policeman with their guns and hand cuffs walked into the room. By this time we were scared and knew something was wrong.
The captain in charge looked straight first to Savey and then to me and asked.
“You know that you are smuggling 14 under age children to USA?”

Savey very self-confident answered, ”Sir, these are earthquake victims. We are taking them to LA for surgery, for treatment and prostheses. They don’t have proper medical care in the Soviet Union. We are Armenians and trying to help these Armenian children.”

“Madam, first of all, you don’t have power of attorney from their parents to take these children out of their homeland. Second ,you do not have entry visas. This looks very suspicious.…..As far as I can see this is a clear case of child trafficking.”
Savey turned to me and asked , “what is child trafficking”?
“ It’s bad. Don’t ask.” I murmured.

Two officers still with their hands on their guns, stood by the door and the rest went inside the adjoining room. We could hear the telephone conversation but did not know what was being said. After some time the captain came and in a firm voice said,
“ I have listened all that was said and you have two choices, ”You either get on the next plane with the fourteen children and go back to Armenia, or your second choice is to go to jail and wait for the immigration judge to resolve the situation .”
“What is our third choice?” Savey asked.
“Lady, you don’t seem to understand what I said. You are talking to an FBI agent. You have only two choices and you better decide on one.”

By now we realized the mess we were in, and could not hold back our tears.

I swallowed my tears and said. “This is not the first time we are bringing children. We brought fourteen children six months ago. Seven of them stayed at Shriners and the other seven at Centinela hospital. After six months , they all received their prostheses we took them back to Armenia. Now the two hospitals in LA know about these children are prepared to take care of them free of charge.” It looked like they were not interested in what I was saying.
I turned to Savey and said, “What are we going to do?”

“Mary, let’s take the second choice, it’s better to go to jail than return those children to Armenia. “
She turned to the officer and said, “ Sir ,we‘ll go to jail but please take care of the children. They must be admitted to the hospital immediately. “

After we had given our decision, the officers went back to the next room. We could hear there was a long discussion, more telephone calls, and after a while the captain walked towards us, and this time with a kind voice said, “We have checked and we do believe you two ladies are bringing the children for treatment. Your intention is virtuous but I hope you realize you did break the law.”

Another officer came and stamped entry visas in the children’s passports. And handed them to us. The captain shook our hands and wished us luck.

We got out of the room. Savey and I hugged and kissed and cried, but this time we cried from
joy.

Outside in the lobby a group of New York Armenians with gift bags of candy and toys welcomed the children. They had been waiting over three hours.

Savey’s tearful statement, was what touched the officer’s heart and convinced them that we were telling the truth.

“ Yes sir, we will go to jail but please take care of the children, they must be admitted to a hospital.”

Yes Savey, you were as always very kind and courageous. You were willing to go to jail as long as the Armenian children got their treatment.

Pashinyan proposes to strengthen trilateral mechanisms for investigation of border incidents, observance of ceasefire

YEREVAN, OCTOBER 15, ARMENPRESS. Prime Minister of Armenia Nikol Pashinyan says it’s possible to change the current situation in the region in case of a political will by achieving stability and peace.

In his remarks during today’s online session of the CIS Council of Heads of State, Pashinyan stated that thanks to Russia’s efforts the military operations stopped in Nagorno Karabakh on November 9, 2020. He stated that according to the trilateral statement signed on November 9, Russian peacekeepers were deployed in Nagorno Karabakh, ensuring security.

“Russia and Vladimir Putin personally played a vital role in the stop of the 44-day war. Today as well they play a vital role in the maintenance of peace in the region. We thank them for all these efforts”, Pashinyan said.

The Armenian PM said that the region is on the verge of transformations and in case of a political will the current picture can change, bringing peace and stability.

“We are ready for those changes. Moreover, it is in accordance with the vision of our government. One of the goals of the government is to open an era of peace. There are factors which question the process of achieving peace in our region. Despite all political efforts, people continue to be killed in Nagorno Karabakh, on the Armenian-Azerbaijani border. On this occasion I propose to strengthen the trilateral mechanisms for investigating the incidents and observing the ceasefire regime. Many not only do not believe, but also they do not want peace and stability in our country, and in such circumstances it’s very hard to move forward the peace agenda. We are determined and will do everything for the establishment of peace and stability in our region. We have a clear vision how to achieve this goal, that is the dialogue and the gradual overcoming of the hostile environment, which, unfortunately, exists in our region, and then the unblocking of transportation and economic communications, this is the only way that will lead to that goal”, Nikol Pashinyan said.

In this context he emphasized the importance of the implementation of all those agreements reached by the 2020 November 9 and the 2021 January 11 trilateral statements.

Pashinyan also informed the session participants that works are underway within the Russian-Armenia-Azerbaijan deputy prime ministerial working group on the re-opening of all transportation communications. He expressed hope to achieve concrete results in the nearest future, which, he added, means that Armenia will have an automobile and railway communication with Russia, a railway communication with Iran, and Azerbaijan will have a railway communication with Nakhijevan via the territory of Armenia.

EAM Jaishankar pays homage at Tsitsernakaberd Memorial Complex in Armenia

The Ministers recognised the shared interests in strengthening connectivity, including the International North South Transport corridor. They briefed each other on the respective regional developments. Dr. Jaishankar said, India supports the OSCE Minsk process. He assured to cooperate closely in international organisations and multilateral forums.

The External Affairs Minister met President of the National Assembly of Armenia Alen Simonyan. They discussed the importance of nurturing the bonds between the two Parliamentary democracies. They spoke about bringing the people closer together through greater cooperation in different domains. Dr. Jaishankar appreciated the National Assembly President’s perspective on regional and international issues of shared interest.

Dr. Jaishankar paid homage to Mahatma Gandhi at his statue in Yerevan. Armenian Foreign Minister Ararat Mirzoyan also paid tributes. Together, they planted a tree of friendship. He met Indian students and Armenian friends of India in Yerevan. He appreciated the efforts made by the Government of Armenia for the welfare of Indian students.

The External Affairs Minister called on Prime Minister Nikol Pashinyan. He conveyed greetings of Prime Minister Narendra Modi. The meeting brought out the many convergences and shared outlook of the two countries. Both sides agreed to develop a broad agenda of practical cooperation that is to the mutual benefit.

Dr. Jaishankar visited the Matenadaran library in Yerevan. In a tweet, he said, the Armenia-India connect is visible in the library. A copy of the Mahabharata in Sanskrit and first Armenian newspaper and Constitution that were published in Madras is in the library. Paintings of the Ajanta caves by noted Armenian Artist Sarkis Khachaturian is at the National Gallery of Armenia in Yerevan.

A Success Story – Intensive Apple Orchard

Since the culture of intensive orchards was new in our country, and we had no experience in that field, we started by setting up one hectare of apple orchards and a year later we decided to expand. Today, with the support of Converse Bank, we enlarged the area from 1 to 4 hectares. The garden is already yielding”, says the owner, Nona Hovsepyan.

According to her, initially a hail protection net and a drip irrigation system were installed in the orchard, due to which they were able to significantly reduce the cost of irrigation water and crop loss due to unfavorable weather conditions.

Today 5 types of apples are grown in the orchard. Although apples are in demand in Armenia, significant part of the yield is exported.

Armenian Son Painfully Remembered, Tortured and Killed in Artsakh War

The only child in the house was Gagik, who would have turned 20 on September 14, but the Artsakh War interrupted his biography. “Gagik grew up in Russia from the age of 6. At first, he stayed with his grandparents until I also managed to move,” Gagik’s mother Lusine says. “We raised him to be a patriot. He could not read or write Armenian, but he spoke well. He had many friends in Gyumri (Armenia’s second largest city). [He is] a very friendly child, helpful, caring. I got divorced when Gagik was three months old,” says Lusine Darbinyan.

19-year-old Gagik Mkrtchyan was supposed to be called up for compulsory military service in 2019. However, due to financial problems, he could not come to Armenia. The mother says that her son decided to go very quickly last year, Gagik immediately decided that he had to go pay his debt to the Motherland. The flight from Rostov took place on August 14. “Because of the pandemic, it was very difficult to find a ticket”.

The boy forbade his mother to come to Armenia with him. At first, the Gyumri military commissariat refused to call Gagik, saying that he was late, let him go and come to the next gathering. Gagik challenged the decision, said that he was already late and demanded to resolve the issue quickly. Gagik was drafted into the army on August 24. The place of service, according to the draw, was Jrakan.

“If he hadn’t gone, he wouldn’t have died,” the mother sighs, “in connection with the virus, those who came from outside had to pass a coronavirus test, he had to self-isolate for 14 days. Gagik quickly passed the test. Аt the military enlistment office, he stated that he had no health problems, did not allow the medical commission to conduct a thorough medical examination, and insisted that he be quickly sent to the army. Gagik had flat feet of the first or second category, in addition, he had a fight in Russia, his right arm was broken by the wrist. If he had allowed a normal medical examination, he definitely would not have been drafted into the army.”

After the draft, Gagik quarantined in Stepanakert for 14 days, and at the end of August he joined the service. In the military unit, the boy began to have abdominal pains, from where he was hospitalized, he was discharged on September 21, and was told that if it happened again, he would be sent to Yerevan. After 6 days, the war began.

“At that time I didn’t understand why he was in such a hurry, but a few months later I found out that before going to Armenia, on August 12th, his Russian friend wrote why Gagik was in such a hurry. Gagik told him that he had learned from friends who serve in the Artsakh Defense Army that there might be a war soon. He goes to be near his friends,” says Lusine.“His close friend, Samvel Hovakimyan, also died. Samvel was a few years older than him, but they were very close. And now I understand why he was so eager to join the army in August.”

Gagik was tall, 1.85 m, he was engaged in boxing, participated in ММА fights. The mother describes the boy as purposeful, fearless, decision-making, persistent and fighting for justice. Gagik spoke to his mother on September 28, saying that he was on the front line. Lusine asked what kind of weapon he was given, he jokingly said a machine gun.

Then he called on October 2 and said that he had been given a new weapon. “He said that he was given a black arrow, I asked what it was, he explained that it was a sniper rifle, and there is a sniper girl with him too. The next call I received was on October 7. Remember that rumors spread that some people went to Jabrayil and told the soldiers to leave, run, Nikol sold the land, you will be sent to the meat grinder. They were told this, but they did not run away, there were 19 of them. Those who said this gave the children an order to hand over their weapons, and then took them to the forest and left them there, it was the evening of October 5.”

According to Lusine, she found out about this already on October 7, when she talked to her son on the phone. “They were found through the military police, as Gagik called our friend in this structure, who called me, so I found out that my son and his friends had disappeared in the forests of Jabrayil. After that, they called the military police of Stepanakert, then Hadrut, so they found them, but took them away, beat them. Gagik called, said ‘I have a big bump on my head, but I’m not offended, the most important thing is that we are saved.'”

Lusine shows a group photo in which everyone is smiling happily – after that, the children were taken to Hadrut. “If you remember, a truce was declared on October 10, but the enemy immediately violated the ceasefire. At that time, Turkish mercenaries took the military base of Hadrut, I don’t know by what miracle they escaped, because the Turks blew up the military unit. Me and other parents found the commander and asked where our children were, he was banging his head on the walls, saying: “don’t demand children from me, they blew up in front of my eyes.”

The information that Gagik and his friends died in a military base was refuted by a call from Gagik. The boy told his mother that he and his friends were hidden in the basement of the church, they had weapons, but there were seriously wounded with them, and they did not know how to get out of the territory that was already under enemy control. It was the last call from Gagik.

“We tried to find anyone, but no one agreed to save them. That night we contacted some Armen, he said that he was the mayor of the City, but then we found out that he was just an employee of the Mayor’s office. He said give me the phone number of Gagik and he will try to find. We gave the number. As he said, he contacted them and directed them to some gorge. He told us that everything was fine.” Lusine sighs, trying to recall the events and chronology of the past months as accurately as possible.

“On October 21, we found one of the officers, named Armen, nicknamed the ‘Bat’. There was no news from my son for a long time, I called him and told him that I was Gagik’s mother, he said that Gagik was with them, he was just on combat duty now, in 6 hours the duty would end and Gagik would call her. So far, these six hours have not passed. Then the number of this Armen became unavailable.”

During the search, Lusine and her relatives tried to meet with wounded soldiers who knew Gagik. They claimed that Gagik was alive, not even wounded, but they did not know exactly where he was. “Gagik was a fan of tattoos, there were very interesting, unique tattoos on his body. He had a large tattoo on his chest in Armenian, ‘only God judges me’. There were knife wounds on the body, and especially the word “God” was mutilated the most.”

The search was fruitless, and Gagik Mkrtchyan’s name appears on the list of missing persons. On the night of December 19-20, Lusine saw a photo of the boy on the Internet. An unknown user who published it wrote that a new video of the captives appeared, but does not publish the video, since there are scenes of violence, and suggested that people who know the guy in the photo write to him, he will send the video. Lusine contacts the user and receives a video that proved that Gagik was captured. In addition to Gagik, there was another prisoner in civilian clothes in the video.

Lusine says he was caught not by the Azeris, but by Turkish mercenaries. The video showed that her son was being severely beaten, but he continued to say that “Karabakh is Armenia. Period.” The Turks kicked him in the face and asked, “It is because you don’t say what we want,” but Gagik continued to say in Armenian, “Ղարաբաղը Հայաստան է և վե’րջ (Karabakh is Armenia).”

“We appealed to international structures with the help of lawyers Artak Zeynalyan, Siranush Sahakyan, the Red Cross, all confirmed that the prisoner is 100% Gagik. According to information received from Baku, Gagik was captured on December 6th and the Hadrut village Tyak. On December 3, we saw in the news that shots were heard in one of the villages of Hadrut, there are survived soldiers who are fighting for their lives. It turned out that it was them, but no one saved them. It turns out that the children were taken prisoner due to lack of weapons and ownerlessness.”

From December 2020 to April 2021, Lusine was unable to obtain any evidence that the boy is alive. Six months after the boy’s disappearance, the mother receives his tortured body. “It was at the beginning of April, when the plane heading from Baku for the prisoners returned empty, that is, information spread that they had brought the dead prisoners, but officially declared that the plane was empty. We started sounding the alarm again, and on April 19th we found Gagik’s body in Mkhitar Heratsi. They called us and said there was a DNA match.”

The mother herself went to identify the body, according to her, the boy was brutally tortured, there were numerous knife wounds on his chest, two gunshot wounds on his leg, his ribs were completely broken, there were burn marks on his body. Gagik was beheaded. Lusine asked the pathologist if the boy’s internal organs were in place and received a negative answer.

“I do not know why, he said that it was because the body was burned, but the body was not so burned that there was not a single internal organ, the fire did not affect only the internal organs, if that was the case, they would have given me not a body, but a handful of ashes. We still don’t know exactly when Gagik was killed. The video was shot on the spot, he was tortured and killed or killed when he was already in Baku. I asked the doctor when death occurred, because the corpse was just beginning to lose its freshness. She said that since there is no head, we may not be able to tell, probably when he called last time. When I showed the video and said that my son was captured in December, she did not give a death certificate, they said that this was already a criminal case. Now a criminal case has been opened in all directions, why the serviceman was killed in captivity and where his head is located.” Lusine says that a month after finding Gagik’s body from the Hadrut district, the corpses of his colleagues with gunshot wounds and traces of an explosion were found.

In the case of the murder of 19-year-old serviceman Gagik Mkrtchyan, Armenian human rights activists appealed to the European Court. At the suggestion of the Ministry of Defense, Gagik’s body was buried in Yerablur. Gagik Mkrtchyan was posthumously awarded the medal “For Military Merit”.
