OH-02: Schmidt Twit Tweets While Free-Speech Supression Case Goes Up

Reeling from the testimony last Saturday of FBI whistleblower Sibel
Edmonds, Jean Schmidt will withdraw four of eight counts of alleged
"false statements" at this morning’s hearing of the Ohio Elections
Commission, in what I have dubbed "the Genocide Denial Trial."

The case to be heard in Columbus at 9:30 am, was brought by our
inestimable Congresswoman against 2008 and likely 2010 challenger
David Krikorian. But it’s now backfiring badly on Ms. Schmidt, who is
being hoist by her own retardedness, so to speak.

It’s never a dull moment in OH-02, and so, on the eve of the hearing,
a Schmidt congressional staffer on the public payroll, one Stephen
Caraway, has been caught tweeting explicit campaign advertising
messages, which is illegal. see

Today’s Hearing

After Schmidt accepted $30,000 from Turkish interests, and then led
opposition to a House resolution that would have recognized the 1915
slaughter of Armenians by Turks as genocide, Krikorian, who happens to
be Armenian, had some choice words for his opponent, voiced in a 2008
campaign flyer. Ever-vigilant in offense against the Constitution,
Jean Schmidt decided to sue before the Ohio Elections
Commission. Hence today’s hearing.

The Elections Commission will conduct the first preliminary hearing
this morning on charges made by Schmidt
ndent. (For the 2010 contest, Krikorian is running as a Democrat and
is likely to capture the nomination.)

Schmidt originally accused Krikorian of making eight "false
statements," all pertaining to her documented receipt of campaign
funds from individuals and groups with direct links to the Turkish
government, and her subsequent outspoken opposition to recognition of
the genocide committed by the Ottoman Turks against Armenians in the
years following 1915.

Ohio’s statute barring "false statements" does not run counter to 1st
Amendment free-speech rights. It is merely a protection for Ohio
voters against statements intended to corrupt the election process. To
take actual examples from Ohio history, if a candidate were to
disseminate information misleading voters about the date of the
election or falsely suggesting that citizens are disqualified from
voting, the Elections Commission would step in to correct the
misinformation and sanction the offending candidate.

The statute does not attempt to restrict normal political discourse by
which a candidate takes issue with an opponent’s positions and
actions, and certainly not if the statements made are demonstrably
true. Ms.. Schmidt, however, has embarked on an excercise in creative
law. She wishes to use the Ohio statute as a shield against
Mr. Krikorian’s First Amendment rights.

Those plans began to backfire on August 8, when Sibel Edmonds, an
ethnic Turk who served as a Turkish and Farsi interpreter for the FBI,
spoke openly for the first time in deposition, in answer to a subpoena
issued by the Ohio Elections Commission in this case. Edmonds
testified to the direct control of the Turkish lobby in America by the
Turkish government, and to the illegal web of influence that lobby has
exerted on US members of Congress.

In other words, Edmonds, herself a Turk, provided hours of credible
testimony backing the truth of the assertions made by Krikorian during
the 2008 campaign. Krikorian told the Dayton Daily News afterward:

"This has to do with one of the absolute b
r country — the flow of money from special interest organizations to
congressmen and senators in exchange for doing their bidding."

Reeling from the Edmonds deposition, which Schmidt’s backers hoped
would be quashed by a Department of Justice gag order, Schmidt’s
attorneys promptly filed a motion to withdraw four of eight alleged
"offenses" claimed under the Ohio elections statute.

A New Schmidt Allegation

As a tactical move to avoid sounding full retreat, Schmidt’s lawyers
have filed a motion to add one new count to her complaint — "her
latest effort to stifle the discussion of political issues and the
working of the marketplace of ideas," according to Krikorian’s reply
memorandum.

At issue is the alleged opening line of the Krikorian 2008 campaign
flyer:
I ask the people of Ohio’s second congressional district to ask
themselvesif our Representative should be taking money from a foreign
government that is killing our soldiers?

Ms. Schmidt claims that is a "false statement" actionable by the
Commission. Krikorian’s attorneys have replied with citations proving
that a rhetorical question cannot be regarded as a "statement" that is
either true or false, under Ohio law. And Ms. Edmonds has testified
that the Turkish government did provide the funds employed by the
Turkish lobby in America, and also was involved in support of Islamic
groups in Central Asia where American troops did become the target.

The alleged false statement was neither false nor a
statement. Discuss.

Future of the Case

Presumably, the Elections Commission will allow the removal of four
counts of the complaint, will disallow the new count based on lack of
merit, and will set a date for full hearing on the four remaining
counts. Krikorian has asked for a postponement until October, so that
Sibel Edmonds can testify in person at the hearing.

Regarding Ms. Schmidt’s most recent legal violation, the seediness of
Mr. Caraway’s action speaks for itself and harkens ba
aign manager and congressional staff director, until the illegality of
that arrangement was pointed out.

Mr. Bennett is the same brilliant spokesman who responded to
revelations in 2006 that Schmidt supported high-level nuclear waste
storage at the eastern end of OH-02 by saying that we of that locale
"are already comfortable with nuclear material in their backyards."
Speaking for myself, I have a comfortable place in mind for
Mr. Bennett.

Only the House Ethics Committe can act against a sitting member of
Congress. This body has been most reluctant to take punitive measures
against Ms. Schmidt in the past — apparently she serves a useful
purpose in her current position for both Republicans and Democrats. We
of Ohio’s Second District only marvel at the apparent conspiracy to
deny us effective representation in Congress.

Case

Ohio Elections Commission To Hold Preliminary Hearing Tomorrow

Cincinnati, OH – August 12, 2009 – FBI Whistleblower Sibel Edmonds,
testified on Saturday to her knowledge of Turkish Government
infiltration of US Department of State and the US House of
Representatives. The testimony was revealing and will be used in David
Krikorian’s defense against frivolous false statement claims brought
by his 2010 opponent Representative Jean Schmidt.

Ms. Edmonds testified that the Turkish Lobby in the United States was
under the direction of the Turkish Government and engaged in
operations including bribery, espionage and blackmail with certain
members of the US House of Representatives to further its objectives
in the United States including one of which is the denial of the
Armenian Genocide.

Representative Schmidt took more money from the Turkish lobby in the
2008 election cycle than any other member of the
ons from the Turkish lobby in 2009 despite there being almost no
Turkish people or interests in Ohio’s 2nd congressional district.

FOX News is reporting today that the Turkish Coalition of America,
whose political action committee is a large contributor to the Schmidt
campaign, had its Armenian Genocide denial ads pulled by Google. A
Spokesman for Google said the company does not allow ads for Web sites
"that suggest revisions to history or attempt to revise history
against the interests of a protected group."

"Jean Schmidt has displayed a pattern of taking money from groups in
exchange for pushing their agendas" said David Krikorian "Whether it
be taking money from the trucking industry to raise the federal weight
limit on tractor-trailer trucks despite the public safety hazard and
road damage concerns or taking money from the banking lobby to push
for bailouts for the banking industry or in this case taking money
from the Turkish lobby in exchange for pushing its denial of the
Armenian Genocide, Jean Schmidt has shown that she is for sale in the
US House.

The Ohio Elections Commission will conduct a preliminary hearing
tomorrow in Columbus. The hearing is open to the public and begins at
9:30 AM. Mr. Krikorian is confidant that the facts of the case will
support his defense against Schmidt’s outrageous claims.

essentially conceded that she does deny the Armenian Genocide.

Jean Schmidt took more money from the Turkish Lobby during the 2008

Turkish Lobby scoreboard has financial advantages for Jean, but what
does it do for our district?" asked Mr. Krikorian adding, "We look

Tel Aviv) has arrived in Armenia on an ordinary working visit, these
visits are frequent, do not make a sensation out of this," Tigran
Balayan, acting foreign ministry spokesperson told a PanARMENIAN.Net
reporter. According to him, the Ambassador of Israel was in Armenia on
Monday, but there is no information whether he is in the country now.

Some media linked the arrival of Shemi Tsura with the collapse of
the Iranian TU-154 flying from Tehran to Yerevan. According to the
Italian press, the plane allegedly had weapons on the board for the
Lebanese Hezbollah movement. The Italian media wrote that Armenia is
allegedly a transit point for arms for Hezbollah.

In particular, the Italian "Corriere della sera" newspaper reported
that except passengers’ luggage the cargo compartment of the TU-154
plane flying from Tehran to Yerevan and crashed on July 15, contained
weapons for Hezbollah: advanced detonators, which has to be delivered
to Lebanon through the territory of Armenia, Turkey and Syria.

Seventeen years ago, Akop Aduryan moved to Los Angeles from his native
Armenia, hoping to make a better life for his young family.

His country was war torn and in economic shambles after the break-up
of the Soviet Union. Together, he and his wife, Ruzanna, who was
pregnant with their second child, decided to start over in America.

Nine days after they arrived, his wife gave birth to another son. They
shared a small three-bedroom home in North Hollywood with 12 family
members.

Aduryan, who had received two degrees in Armenia, worked making jewelry
with his brother to support his family. After they moved into their
own apartment, he and his brother worked together as mechanics. With
money still tight, four years ago he took a second job as a night
security guard.

Each weeknight his routine was the same. He would get home from his
work as a mechanic around 6 p.m., take a short nap, then leave for his
job as a security guard at 8 p.m. He would return home for roughly
half an hour between 9 and 9:45 p.m., then leave again for work and
come home at midnight, said his older son Chris, 18.

On July 23, Aduryan followed his usual pattern. He arrived home
about 9 p.m. on his break from guarding outside an insurance company
building at Victory Boulevard and Laurel Canyon Boulevard in North
Hollywood. Forty-five minutes later he went back to work.

What happened next makes no sense to his wife and sons.

About 11 p.m., Aduryan got into a heated argument with a group of
Armenian men in a somewhat secluded area in the 7500 block of Goodland
Avenue in Sun Valley – along the back fence of the Charles Leroy
Lowman Special Education Center, a school for special needs children.

He was more than two miles from his security guard post.

A woman who lives on the street said she was watching television when
she heard shots.

"It sounded like firecrackers on July 4th. One after another
like boom, boom, boom, boom," said Edna, who did not want to be
identified with her last name because the assailants have not been
found. "About an hour later a policeman came to my door and said it
wasn’t firecrackers. He told me a guy was shot and he was killed….I
said a little prayer."

Edna said she had spoken to several of her neighbors about the
incident, and nobody could recall something similar happening on her
street in the last 25 years.

LAPD Det. Kirk Patrick said witnesses were unable to identify
the suspects because the shooting happened in a somewhat dark and
secluded area.

Patrick said police arrested a person in connection with Aduryan’s
killing, but the district attorney’s office declined to file charges
because of insufficient evidence. Patrick said police determined the
incident was not related to Aduryan’s work as a security guard. He
said he believed Aduryan had agreed to meet the man or men who killed
him at that location.

Aduryan’s family described him as a loving man, always willing to
put his family before himself. Chris Aduryan said they had to force
him to travel and take time off from work. He had saved up to buy
his wife nice earrings for their 20th anniversary, and had recently
spent a weekend with his family at Zuma beach near Malibu.

They said he tended to interfere when he saw something happening he
thought was wrong, and his son guessed that that tenacity might have
gotten him killed.

Ruzanna Aduryan thumbed through old family photo albums and at times
tried to hold back tears, recalling her recent wedding anniversary
and holding the earrings he had given her.

"It’s still a mystery why he was on that street," she said.

YEREVAN, AUGUST 11, ARMENPRESS: "Available Apartment for Youth"
state purposeful program has been presented to the discussion of
the government. Sports and Youth Affairs Minister Armen Gevorgyan
told Armenpress that the program has been complemented as a result
of joint discussions with the Armenian Central Bank. It is expected
that in near future it will be approved by the government after which
will be brought into life. The minister said it has not gone essential
changes and supposes state assistance to young families. The priority
will be given to those having more children.

The goal of the program is to assist young socially insecure families
in overcoming apartment issue, improve demographic situation in the
country, decrease the emigration, promote hypothec crediting system.

The program also intends state assistance to young families in
acquiring apartment through hypothec credit.

Armenian citizens of 18-30 years old, those families where one member
is under 30 or an only parent under 30 taking care of a child may
become the beneficiaries of the program.

The minister said more than 1000 initial applications have already
been received for the program. After the approval of the government
main assistance process will start.

YEREVAN -The construction of the "Armenia" hotel complex for the
2014 Olympic Games in Sochi will kick off in 2010. Armenia’s chief
architect Narek Sargsyan said that Russia has provided a plot of land
in Sochi to each of the CIS countries for construction of hotels.

The hotels will be constructed under the patronage of the governments
by private companies. With the decision of the Armenian government
Armenia’s private investor is the "Bamo" company.

Sargsyan said that in order to have the highest quality project, the
Bamo company, in conjunction with Armenia’s Urban Development Minsitry,
announced an international request for proposals. The organizers of
the tender were the urban ministry and the Russian Union of Architects,
of which Sarsyan is co-chairman. He also chaired the jury.

The RFP was announced two months ago and in a short time 43 proposals
were presented, of which 27 were reviewed. With the unanimous decision
of the jury, the project was awarded to the Armenian Project Institute
headed by Sargis Sardaryan. The Bamo corporation is expected to sign
a contract and begin the construction effort.

"The submission of so many proposals in such short period of time
shows the great interest displayed toward the project," said Sargsyan.

YEREVAN, AUGUST, NOYAN TAPAN. Public relations, which unlike interstate
ones, involve wider people’s mass, are of rather pivotal role in the
issue of improvement of the Armenian-Turkish relations. Turkologist
Ruben Melkonian expressed such an opinion at the August 7 press
conference. In his words, the Tukish society has a problem of truth
for communication with the Armenian society, that is perception and
realization of the historic past.

>From this viewpoint, unawareness exists in the Turkish society in
the consequence of which their majority displays denying approach.

In R. Melkonian’s opinion, unlike the Turkish society, a calmer and
surface position prevail among the Armenian society. In his words,
it’s reason is that the Armenian society better knows its past.

Touching upon the possible warming of the Russian-Turkish relations,
the Turkologist mentioned that Armenia must be able to orient and
conduct a right policy in that issue.

R. Melkonian thinks that the statement on RA President Serzh Sargsyan’s
visiting Turkey contains messages in reminding about arrangements
with Turkey. In his words, the viewpoint is spread that the Turkish
President visited Armenia without preconditions while the RA President
presented preconditions for visiting Turkey.

has finished his recent book about Vyacheslav Kirillovich Ivankov,
a Russian "underworld lord" (nickname: Yaponchik). It took the author
10 years to write the book, as he said today during a meeting with
journalist.

Touching upon the recent assault committed against Ivankov on
July 28, the writer characterized it as an attempt to intimidate
Yaponchik. "Heaven forbid if Ivankov died. If that happens, criminals
all over the world will start a ‘global war’, because the sphere
of their activity covers the whole planet, from America to Japan,
and Armenia will not manage to avoid the war."

There are 592 "underworld lords all over the world, Galoyan said,
stressing the seriousness of their role in "governing states and
actually the entire planet."

On July 28, Vyacheskav Ivankov (Yaponchik), one of the best-known
figures of the criminal world, was assaulted in Moscow. The "underworld
lord" was hospitalized in grave condition.

In early 1990’s, Yaponchik was considered a mafia leader in US,
FBI reports. However, accused of extorting money from Chara bank,
he was later sentenced to a long-term imprisonment.
