US Supports Azerbaijan in Karabakh Issue

The United States (US) does not recognize Upper Karabakh as an
independent state and supports Azerbaijan’s territorial integrity,
according to a report released by the US Department of State on
Monday.

“The United States does not recognize Upper Karabakh as an
independent state, as its authorities are not recognized either by
the international community or the US. The US supports Azerbaijan’s
territorial integrity and believes that the future status of Upper
Garabagh should be determined through talks between the parties.”

The US report, which cites key figures and the history of the
Karabakh conflict, says the United States continues to play an active
mediating role in resolving the problem in peace and supports seeking
settlement options within the OSCE Minsk Group.

The report also says that the armed conflict over Upper Karabakh
continued between 1990 and 1994. After the ceasefire was reached in
1994, Armenian armed forces controlled Upper Karabakh and the
adjacent extensive territories. As a result of military action and
the ousting of Azerbaijanis from their homes, over a million people
became refugees and displaced persons.

Apart from Karabakh, Armenian forces occupied other Azerbaijani
towns. Armenian State moreover does not recognise Turkey’s
territorial integrity. The Armenian Constitution and Declaration of
Independence call Turkey’s Eastern provinces ‘Western Armenia’. In
addition, the Armenian irredentism towards Turkey, Azerbaijan and
Georgia is strong.

MOSCOW

Russia’s Foreign Minister Sergey Lavrov “will be visiting Armenia in
the second half of February before his visit to Georgia”. Aleksandr
Yakovenko, the official representative of the Russian Foreign
Ministry, has reported this today.

In his words, “the visit will be taking place before the head of the
Russian Foreign Ministry’s visit to Georgia, which is planned for 18
February”.

Yakovenko reported earlier that the minister intends to make trips to
all the capitals of the CIS [Commonwealth of Independent States].

Sergey Lavrov “is planning to visit all the commonwealth’s states soon
in order to discuss the process to reform the CIS”. Russia, noted
Yakovenko, “is heading this work in the commonwealth and is currently
gathering proposals from participating countries”.

Sergey Lavrov’s talks in Baku with the Azerbaijani leadership ended
today.

As is known, on the invitation of President of the Islamic Republic
of Iran Seyyed Mohammad Khatami, the President of the Republic of
Azerbaijan Ilham Aliyev has been on an official visit to Iran with a
representative delegation on January 24-26, 2005.

During the visit, President of Azerbaijan Ilham Aliyev, in a friendly
atmosphere has carried out discussions and talks with the President
of Iran Mr. Khatami, the Supreme Leader of the Islamic republic of
Iran Ayatollah Seyed Ali Khamenei, the Chairman of the State Advisory
Council of the Islamic Republic of Iran Ali Akbar Hashimi Rafsanjani,
Chairman of Majlis of the Islamic Council Haddad Adel, foreign
minister Kamal Kharrazi, and also visited the city of Tabriz.

As a result of the talks and discussions, the sides have issued joint
statement, whereby, it is emphasized their readiness to take further
steps to strengthen their cooperation based on friendly ties,
equality and mutual respect. In the statement, Iran and the Republic
of Azerbaijan also reaffirmed their support for the principles of the
United Nations Charter, including respect for the sovereignty and
independence of countries and other rights recognized by
international law.

The statement also reiterated the common intent to establish direct
ties between economic institutions within their respective
jurisdictions in addition to further consolidating bilateral ties,
particularly, in the political sphere, and intensifying cooperation
in the campaign against international terrorism, drug trafficking and
organized crime. The statement also reflects the shared views of Iran
and Azerbaijan regarding the Nagorny Karabakh conflict for
implementation of related Resolutions of the United Nations and
Organization of the Islamic Conference. It stressed expansion of
mutual ties in various economic fields, boosting of their trade
volume, with special emphasis on oil and petrochemicals, small
industries, industrial and agricultural machineries, and in their
transport and communications sectors. It also stressed promotion of
cultural, artistic, media, scientific, educational, health and social
cooperation.

The two states also made it clear in their statement that they would
take measures necessary to defend the Caspian’s status as a “sea of
peace and stability,” and affirmed the need to continue their
constructive talks aimed at establishing a legal regime for the
Caspian Sea acceptable to all five littoral states.

YEREVAN, JANUARY 27. ARMINFO. The Council of Europe will not make an
initiative of involvement of the representatives of Nagorny Karabakh
in the process of settlement of the Karabakh conflict, as it can be
considered as an attempt of interfere in the activity of the OSCE
Minsk Group from the CE. Secretary General of the Council of Europe
Terry Davis stated during the press conference, Thursday.

At the same time he stressed that representatives of Azerbaijan has
made many complaints against the activities of OSCE Minsk Group. “I
see why the authorities of Azerbaijan are not satisfied with the
activities of the OSCE MG, however, the progress in settlement of the
Karabakh conflict may be reached only on the basis of the dialogue”,
he mentioned. At the same time, Terry Davis stressed that a progress
may be registered in the negotiation process on settlement of the
Karabakh conflict only when involvement of representatives of Nagorny
Karabakh in it. “The representatives of Nagorny Karabakh of course
must take part in the negotiation process, and it concerns not only
representatives of the Armenian population of Nagorny Karabakh, but
also of the Azerbaijani population”, CE Secretary General stated. He
reminded that the PACE Resolution on Nagorny Karabakh says that the
authorities of Azerbaijan must establish contacts with representatives
of the population of Nagorny Karabakh without any pre-condition.

“I will assist in every possible way the implementation of this
provision of the resolution, as it is necessary to seek a way of
settlement of the Karabakh conflict. The continuation of the
negotiation process for settlement of the Karabakh conflict without
representatives of Nagorny Karabakh will be the same if we try to
solve the problem of Northern Cyprus without representatives of the
Turkish population living there”, Terry Davis pointed out. He informed
that he has received many letters from residents of Nagorny Karabakh
who complained that the Karabakh problem is solved without taking into
consideration their opinions.

Baku, 27 January: “The OSCE Minsk Group cannot resolve the Karabakh
conflict for Azerbaijan and Armenia. The cochairmen of the OSCE Minsk
Group can support the governments of Armenia and Azerbaijan in
establishing dialogue and holding talks. Confidence should be built
between the leaders of the two countries in the first place and then
between the peoples,” the new French cochairman of the OSCE Minsk
Group, Bernard Fassier, said at a news conference in Baku today.

Commenting on the resolution of PACE [Parliamentary Assembly of the
Council of Europe] on Nagornyy Karabakh, Fassier said that “this is
the position of an organization which is one of the major pillars of
democracy in Europe”. Fassier believes that other organizations
should express their position on the Karabakh conflict as well.
Pointing to the interest of the EU and the UN in the conflict, Fassier
expressed the wish that those organizations adhere to a single
position and not compete with each other.

In Fassier’s opinion, the OSCE Minsk Group does not have adequate
resources to facilitate a solution to the conflict. “The Minsk Group
is a political forum. It can put forward political ideas. However, it
does not have financial resources to implement those ideas. But the
European Union has enough economic capacity,” Fassier said.

Moscow, 27 January: The upcoming S-400 Triumf air defence missile
system will possibly be tested on the proving ground in Kazakhstan,
deputy commander-in-chief of the Russian air force in charge of the
CIS’s unified air defence system, Lt-Gen Aytech Bizhev, told
journalists today.

“The possible transfer of the testing of the S-400 to Kazakhstan is
linked to the fact that the Russian proving grounds at Ashuluk and
Kapustin Yar have limited possibilities in respect of the distance of
firing,” Bizhev noted. At the same time the Balkhash proving ground in
Kazakhstan makes it possible to fully check the combat potential of
the new air defence missile system, which is designed to destroy
cruise missiles and aircraft as well as warheads of ballistic missiles
at a wide range of heights and at a range of up to 400 kilometres.

The Triumf air defence missile system was developed at the Almaz
central design bureau. It is expected to be used to fight airborne
targets as well as in the interests of nonstrategic antimissile
defence. The chief of staff of the air force, Col-Gen Boris Cheltsov,
said in December 2004 that Triumf will arrive in the forces in 2005.

Members of the CIS unified air defence system, which in a few days’
time will mark its 10th anniversary, are Russia, Armenia, Belarus,
Kazakhstan, Kyrgyzstan, Tajikistan, Ukraine and Uzbekistan.

Nagorno Karabakh, Azerbaijan and Armenia is available in Turkey,
Armenian Foreign Minister Vardan Oskanian stated in an interview with
Zaman Turkish newspaper. “The most important thing in this issue is
that the Armenians of Karabakh struggle for their independence. They
do not wish to be citizens of Azerbaijan and be its part,” he said.
Touching upon the issue of Turkey’s mediation, V. Oskanian reported
that Armenia cannot agree to it, as being Azerbaijan’s ally official
Ankara supports that country everywhere and in anything. He reminded
that Nagorno Karabakh has always been an Armenian territory. “As of
the “occupied regions”, the issue should be settled by Karabakh and
Azerbaijan,” the head of the Armenian Foreign Ministry said.

CHURCH, OTHER ORGANIZATIONS, RECEIVE FUNDS IN HONOR OF LOST ARMENIANS

They were grocers, merchants, and homemakers. They were Armenians who
were killed and lost in the Genocide in 1915. They were also customers
of New York Life.

On Thursday, January 27, 2005, the insurance giant began to make good on
its promise to insure the lives of these Genocide victims.

As part of a $20 million settlement reached between New York Life and
descendents of its policy holders massacred in the Genocide, the company
contributed a total of $3 million to nine Armenian organizations.

While most of the settlement will go to descendents of the original
policy holders, this $3 million to charitable organizations is a
symbolic payment to those Armenians who left behind no descendents or
whose entire families were wiped out in the Genocide.

“I’m pleased to see the money from the settlement directed toward these
charities,” said Brian Kabatek, a half-Armenian Los Angeles-based
attorney who was one of the lead lawyers in the class action suit.
“They were selected because they were instrumental in helping Armenians
settle in the United States after the 1915 Armenian Genocide. My family
benefited from these charities when they arrived in America so long
ago.”

The Diocese of the Armenian Church of America (Eastern) was one of the
organizations to receive $333,333 as part of the settlement. The money
must be used for charitable purposes, and cannot be used to cover
administrative or capital costs. The Attorney General of California,
where the suit was brought, will oversee the use of the funds by the
nine organizations.

“It is a solemn day, thinking that we receive this money because of the
suffering of our people,” said Dr. Sam Mikaelian, executive director of
the Diocese who accepted the money on behalf of the Diocese during a
ceremony at the Armenian General Benevolent Union’s New York City
offices on January 27, 2005. “However, we are resolved to find a way to
use these funds to honor the memories of the countless Armenians lost to
the Genocide. Their legacy will live on as we, thanks to this gift, are
able to provide more services and outreach to Armenians.”

The Diocese has not yet determined how best to use the funds. Also
receiving $333,333 are: the Western Diocese of the Armenian Church of
America, The Armenian General Benevolent Union, the Armenian Educational
Foundation, the Armenian Relief Society, the Eastern and Western Prelacy
of the Armenian Church, the Armenian Catholic Exarchate for the U.S. and
Canada, and the Armenian Missionary Association of America.

LAWSUITS CONTINUE

The settlement with New York Life brings to a close America’s longest
contested insurance settlement: 90 years have elapsed between the death
of policy holders and payment.

The class action suit was originally filed in November 1999 on behalf of
Martin Marootian, an 89-year-old who lost his family members to the
Genocide. His uncle, Setrak Cheytanian, had an insurance policy with
New York Life.

“I have in my possession an insurance policy on my uncle’s life, which
my mother and older sister had been trying to collect since 1923. They
came to America in 1914 with the insurance policy,” Marootian said in a
recent interview with the AGBU. “[New York Life] claimed they had no
records of the policy and wanted proof of death — they wanted to make
sure that we were the proper heirs. She had to write to the Patriarch
in Constantinople to verify that there was a massacre in Kharpert and he
had died. Time went by and my mother received a death certificate
notice from the Patriarch only in May 20, 1956. We got all those papers
together and still we couldn’t make any headway with New York Life.”

Along with Marootian, New York Life now acknowledges that a review of
its records shows that an estimated 2,400 policies sold to Armenians in
the Ottoman Empire may remain unpaid.

The lawyers who negotiated the settlement — Kabateck, Vartkes
Yeghiayan, Mark Geragos, and William Shernoff — are also in
negotiations with two other companies, which are as yet unnamed.

Armenians who think their family members might have had policies with
New York Life and are due settlement, can get more information on the
case and search a list of policy holders by visiting the website

Descendants have until March 16 to make a claim for a portion of the $20
million settlement with New York Life.

Attending the ceremony were California Insurance Commissioner John
Garamendi and Bill Werfelman, a representative from New York Life.

APN hosts Armenian Chamber of Commerce

On Thursday, January 20th, 2005 the Armenian Professionals Network
(APN) hosted an event in honor of the Chamber of Commerce and Industry
of the Republic of Armenia, presided by His Eminence Archbishop Hovnan
Derderian, Primate of the Western Diocese and attended by Council
member Frank Quintero. The event was APN’s first of the year, and
introduced the newly formed Chamber tothe community. Mr. Arture
Zabounian, Vice-Chairman of APN serves as Master of Ceremonies.

Several representatives of the Chamber spoke about their work and
goals, as well as possibilities for local businesspersons. The
speakers included: Grant Dagstanyan (Director), as well as Mr. Parsegh
Kartalian and Mr. Khatchig Khoudikian (advisors of the chamber). Other
members of the Chamber of Commerce also took the podium, including
Mr. Adrin Nazarian, government relations consultant; and Miss Annette
Vartanian, executive director of the Armenian-American Chamber of
Commerce. The event was extremely successful in introducing to those
present the many facets of the Chamber of Commerce and Industry of the
Republic of Armenia, including its missions, history and activities.

Present during the event were also several individuals running for
different government positions: Mrs. Laura Vartanian, Mr. Vahe
Hovanessian, Mr. Chahe Keureglian, and Mr. Vrej Agajanian. At the
close of the event Mr. Vahe Ashjian, Chair of APN informed the
attendees of the role of APN within the community and introduced the
Executive committee of APN. In his address His Eminence Archbishop
Hovnan Derderian welcomed Mr. Frank Quintero as a member of APN and
thanked him for his unwavering support of the organization. The
Primate also commended the diligence of APN, congratulated them on
making their first event of the year a success, and wished them luck
